“Supply of pharmaceutical products to the Public Health Care Department in Siemiatycze”

1. The subject of the contract is the delivery of medicines, hereinafter referred to as THE SWZ: goods, for the Independent Public Health Care Institution in Siemiatycze, hereinafter referred to as the Ordering Party, in the quantity and assortment and with the parameters specified in Annex 1 to the SWZ – Assortment and quantity form. 2. A detailed description of the subject of the contract, a list of the required limit parameters covered by the delivery listed in paragraph 1 shall include an assortment and quantity form with a description, constitute Annex 1 to the SWZ in detailed parts of packages from 1 to 164 to the offer, constituting an integral part of it, and then an integral part of the delivery contract. The data (parameters) mentioned in the subject of the contract and any indications concerning the device (components) should be understood as defining technical parameters or quality standards. 3. The quantity of goods specified in the SWZ, intended for purchase during the term of the contract, has been determined in an estimated manner. The quantity of goods purchased by the Ordering Party during the term of the Agreement may be smaller and the Contractor shall not be entitled to any claims against the Ordering Party, provided that the Ordering Party acquires goods with a value not lower than 60% of the total net value of the Agreement specified in § 4 section 1. (model contract) In the case specified in the previous sentence, the Contractor is entitled to remuneration only for properly performed deliveries in accordance with the Agreement.
