The subject of the contract is the supply of 173 pieces of saw sets and 173 pieces of portable slurry pumps with accessories, divided into 8 parts. The subject of the contract is to be brand new, unused and not displayed at exhibitions or trade fairs, technically efficient, safe, compatible
with applicable quality norms and standards, complete and ready for use, and must meet the minimum technical, functional and quality requirements specified in Annex 1A to the SWZ – for Parts I – IV and in Annex 1B to the SWZ – for Parts V – VIII. Year of manufacture of the assortment being the subject of all parts of the order – not earlier than 2022.
Part I – Delivery of 37 saw setsThe subject of Part I of the order is the delivery of 37 pieces of saw sets.
The saw kit includes the following components:
- petrol chainsaw,
- protective head helmet with face shield and ear pads,
- leather five-finger protective gloves,
- protective legs/legs.
- a set of wedges to topple a tree min. 2 pcs.
- splitting axe.

Information about electronic means of communication.
1. In the procurement procedure, communication between the Contracting Authority and the Contractors takes place using: ZETOPZP Public Procurement Platform: https://przetargi.lubelskie.straz.gov.pl/ and e-mail at: zampub@kwpsp.lublin.pl, however, the submission of an offer together with the documents attached to the offer may take place only via the Public Procurement Platform ZETOPZP https://przetargi.lubelskie.straz.gov.pl/
2. The use of the Platform is free of charge.
3. User's instructions - for using the ZETOPZP Public Procurement Platform can be found on the Portal, in the "Help" tab and has been posted on the website of the proceedings.
4. By joining the public procurement procedure, i.e. by registering or logging in free of charge, in the case of having an account in the ZETOPZP Public Procurement Platform, the Contractor accepts the terms of use of the Platform, specified in the Regulations posted on the https://przetargi.lubelskie.straz.gov.pl/ website, and considers them binding.
5. General rules for using the Platform:
a) notification to the proceedings requires the Contractor to log in to the System on the subdomain https://przetargi.lubelskie.straz.gov.pl/#/authentication/login
b) In order to join the proceedings, the Contractor must set up an account on the https://przetargi.lubelskie.straz.gov.pl/#/authentication/register Platform, where he will be notified about the possibility of logging in or creating a free account. The Contractor creates an account by following the steps of the registration process; provides an e-mail address, receives an activation link and then sets a password;
c) The registration process of the Contractor is fully automatic, after registration, the data of the company that the person creating the account represents.
d) After creating an account, the Contractor has the opportunity to submit an Offer in the proceedings. Communication between the Contracting Authority and the Contractors, in particular notifications and information, is provided in electronic form via the Platform and e-mail notifications.
6. The contracting authority, in accordance with Article 67 of the Public Procurement Law, shall specify the following technical requirements:
and organizational preparation, sending and receiving electronic correspondence using the Procurement Platform, i.e.:
a) permanent access to the Internet with a guaranteed bandwidth of not less than 512 kbps;
b) PC or MAC class computer, with the following configuration: min 2GB RAM memory, Intel IV 2GHZ processor, one of the operating systems - MS Windows 10, Mac Os x 10.4, Linux, or their newer versions;
c) any web browser, preferably the latest version available, that supports TLS 1.2 is installed, with the exception of Internet Explorer;
d) JavaScript enabled;
e) Installed Acrobat Reader or another program that supports files in the .pdf format.;
f) a cryptographic card reader issued by the issuer of the certificate used by the Contractor connected or built into the computer.
Part II – Delivery of 42 saw setsThe subject of Part II of the order is the delivery of 42 pieces of saw sets.
The saw kit includes the following components:
- petrol chainsaw,
- protective head helmet with face shield and ear pads,
- leather five-finger protective gloves,
- protective legs/legs.
- a set of wedges to topple a tree min. 2 pcs.
- splitting axe.

Information about means of electronic communication c.d.
7. The Contracting Authority, in accordance with §11 section 2 of the Regulation of the Prime Minister of 30 December 2020 on the method of preparing and transmitting information and technical requirements for electronic documents and means of electronic communication in the public procurement procedure or competition (Journal of Laws of 2020, item 2452), shall provide the following information on the connection specifications, the format of the transmitted data and encryption and marking the time of transmission and receipt Data:
a) acceptable formats of transmitted data, i.e. files up to 100 MB in the following formats: .txt, .rtf, .pdf, .xps, .odt, .ods, .odp, .doc, .xls, .ppt, .docx, .xlsx, .pptx, .csv, .jpg (.jpeg), .tif (.tiff), .geotiff, .png, .svg, .wav, .mp3, .avi, .mpg, .mpeg, .mp4, .m4a, mpeg4, .zip,.tar, .gz (.gzip), .7Z, .xsl, XAdES, PAdES, CadES;
b) information on the encoding and time of data receipt: - the file attached by the Contractor on the ZETOPZP Public Procurement Platform and saved, is visible in the System as encrypted - UTF8 encoding format. The possibility of opening the file is available only after decryption by the Ordering Party after the deadline for submitting tenders;
8. The time stamp of data receipt by the Platform is the date and the exact time (hh:mm:ss) generated by the Microsoft Azure time, which is synchronized with the UTC timestamp. The contractor should carefully read this SWZ and submit a bid in accordance with its requirements.
9. The Contractor may request the Contracting Authority to clarify the content of the SWZ. Questions may be asked via e-mail to the following address: zampub@kwpsp.lublin.pl or via a special module placed on the Public Procurement Platform ZETOPZP https://przetargi.lubelskie.straz.gov.pl/. In order to use the module on the ZETOPZP Public Procurement Platform, go to the "Questions and answers" section and then click the "Ask a question" button, at this point the system will open a form in which you should enter the content of the question and (if necessary) add an attachment. Then click the "Ask a question" button. Questions can only be asked by logged in users (to ask a question you must have an account in the application).
10. The Contracting Authority is obliged to provide explanations immediately, but not later than 6 days before the deadline for submitting tenders, provided that the request for clarification of the content of the SWZ was received by the Contracting Authority no later than 14 days before the deadline for submitting tenders.
11. If the Contracting Authority fails to provide explanations within the time limits referred to in point 10, it shall extend the deadline for submission of tenders by the time necessary for all interested Contractors to familiarize themselves with the explanations necessary for the proper preparation and submission of tenders.
12. The extension of the deadline for submission of tenders shall not affect the time limit for submitting a request for clarification of the content of the SWZ referred to in point 10.
13. If the request for clarification of the content of the SWZ has not been received within the time limit referred to in point 10, the Contracting Authority is not obliged to provide explanations to the SWZ and the obligation to extend the deadline for submitting tenders.
14. The content of inquiries together with explanations is made available by the Contracting Authority on the website of the conducted proceedings, i.e. https://przetargi.lubelskie.straz.gov.pl/
Part III – Delivery of 49 saw setsThe subject of Part III of the order is the delivery of 49 pieces of saw sets.
The saw kit includes the following components:
- petrol chainsaw,
- protective head helmet with face shield and ear pads,
- leather five-finger protective gloves,
- protective legs/legs.
- a set of wedges to topple a tree min. 2 pcs.
- splitting axe.

Clause regarding the processing of personal data
1. In accordance with Article 13(1) and (2) and Article 14(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). UE L 119 of 04.05.2016, p. 1), hereinafter referred to as "GDPR", I inform that:
a) the administrator of personal data of natural persons obtained in the course of an open tender for "Delivery of 173 pieces of saw sets and 173 pieces of portable slurry pumps with accessories divided into parts" (WL.2371.14.2023) is the Lublin Provincial Commander of the State Fire Service
Strażacka 7, 20 – 012 Lublin;
b) a Data Protection Inspector has been appointed at the Provincial Headquarters of the State Fire Service in Lublin: (20-012 Lublin, Strażacka 7, tel. 81 53 51 237, e-mail: iod@kwpsp.lublin.pl);
c) personal data will be processed on the basis of art. 6 par. 1 lit. c GDPR for purposes related to the public procurement procedure carried out on the basis of the provisions of the Act of 11 September 2019. Public procurement law (i.e. Journal of Laws of 2022, item 1710, as amended) in an open tender procedure for "Delivery of 173 pieces of saw sets and 173 pieces of portable slurry pumps with accessories divided into parts" (WL.2371.14.2023);
d) The recipients of personal data will be persons or entities to whom the documentation of the proceedings will be made available pursuant to Article 74 paragraphs 1 and 2 of the Act of 11 September 2019. Public procurement law (i.e. Journal of Laws of 2022, item 1710, as amended);
e) Personal data will be stored for a period of 20 years from the date of completion of the procurement procedure;
f) The obligation to provide personal data is a statutory requirement specified in the provisions of the Public Procurement Law, related to participation in the public procurement procedure; the consequences of failure to provide certain data result from the Public Procurement Law;
(g) With regard to personal data, decisions will not be taken in an automated manner applying to Article 22 of the GDPR;
(h) The person whose personal data was obtained in the ongoing proceedings shall have the following rights:
− pursuant to Article 15 GDPR, the right to access personal data;
− pursuant to Article 16 of the GDPR, the right to rectify personal data;
− pursuant to Article 18 GDPR, the right to require the controller to restrict the processing of personal data subject to the cases referred to in Article 18 (2) of the GDPR;
− the right to lodge a complaint with the President of the Office for the Protection of Personal Data when a person whose personal data was obtained in an ongoing proceeding considers that the processing of personal data relating to that person violates the provisions of the GDPR;
(i) The person whose personal data was acquired in the ongoing proceedings shall not be entitled to:
- in connection with Article 17(3)(b), (d) or (e) of the GDPR, the right to erasure of personal data;
- the right to transfer personal data referred to in Article 20 of the GDPR;
- pursuant to art. 21 GDPR, the right to object to the processing of personal data, as the legal basis for the processing of your personal data is art. 6 par. 1 lit. c GDPR.
Part IV – Delivery of 45 saw setsThe subject of Part IV of the order is the delivery of 45 pieces of saw sets.
The saw kit includes the following components:
- petrol chainsaw,
- protective head helmet with face shield and ear pads,
- leather five-finger protective gloves,
- protective legs/legs.
- a set of wedges to topple a tree min. 2 pcs.
- splitting axe.

j) The recipient of your personal data will also be ZETO Lublin Sp. z o.o. with its registered office in Lublin at Diamentowa 2, 20-447 Lublin, entered into the Register of Entrepreneurs of the National Court Register, kept by the District Court Lublin-Wschód in Lublin with its registered office in Świdnik, VI Commercial Department of the National Court Register under KRS number: 0000053608, REGON: 430248589, NIP: 7120156688, as the owner of the Public Procurement Platform PZP https://przetargi.lubelskie.straz.gov.pl/, where the Provincial Headquarters of the State Fire Service in Lublin conducts public procurement proceedings, operating at: https://przetargi.lubelskie.straz.gov.pl/.
Limitations of the application of the GDPR:
1. The exercise by the data subject of the right to rectify or supplement personal data referred to in Article 16 of Regulation 2016/679 may not result in a change in the outcome of the public procurement procedure or in a change in the provisions of the contract to the extent inconsistent with the Act;
2. In the procurement procedure, the submission of a request for restriction of processing referred to in Article 18(1) of Regulation 2016/679 shall not restrict the processing of personal data until the end of that procedure.
3. If submitting a request for the right referred to in Article 18(1) of Regulation 2016/679 results in a restriction of the processing of personal data contained in the protocol of the procedure or annexes thereto, the contracting authority shall not make such data available from the date of completion of the procurement procedure, unless the conditions referred to in Article 18(2) of Regulation 2016/679 are met.
4. The release of the minutes and the annexes to the minutes shall apply to all personal data, with the exception of the data referred to in Article 9(1) of Regulation 2016/679, collected in the course of the procurement procedure. The limitations of the principle of disclosure referred to in point 3 and Article 18(3)-(6) of the PPL shall apply mutatis mutandis.
Part V – Delivery of 37 portable slurry pumps with accessoriesThe subject of Part V is the delivery of 37 pieces of portable slurry pumps with accessories. The kit includes the following items:
-Szlamowa motor pump,
- suction hose matched to the suction base of the motor pump min. 2.5 m - pcs. 2,
- suction basket matched to the suction hose - pcs. 1 with mesh meshes adapted to the size of the motor pump's impurities,
- pressure hose W75 1 pc equipped with STORZ type aluminum fittings in accordance with PN-91/M-51031 or equivalent, holding a CNBOP approval certificate.

Grounds for exclusion from proceedings.
1. Contractors who are not subject to exclusion from the procedure pursuant to Article 108(1) of the Public Procurement Law, Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in connection with the award of the contract may apply for the award of the contract
with Russia's actions destabilizing the situation in Ukraine (Dz. EU No L 229, 31.7.2014, p. 1) and Article 7(1) of the Law on special arrangements for counteracting support for aggression against Ukraine and for the protection of national security
(Journal of Laws of 2022, item 835, as amended) (mandatory grounds for exclusion from the proceedings) and on the basis of Article 109(1)(4) of the Public Procurement Law (optional condition for exclusion from the proceedings).
2. The Contractor shall be excluded from the procurement procedure (Article 108(1) of the Public Procurement Law):
(a) who is a natural person who has been finally convicted of an offence:
- participation in an organized criminal group or association aimed at committing a crime or fiscal offense referred to in Article 258 of the Criminal Code,
- trafficking in human beings referred to in Article 189a of the Criminal Code, referred to in Articles 228-230a, Article 250a of the Criminal Code, in Articles 46 - 48 of the Act
of 25 June 2010 on sport or in Article 54(1)-(4) of the Act of 12 May 2011 on the reimbursement of medicines, foodstuffs for particular nutritional uses and medical devices (Journal of Laws of 2021, item 523, as amended);
- financing a terrorist offence referred to in Article 165a of the Criminal Code or the offence of preventing or hindering the determination of the criminal origin of money or concealing its origin, referred to in Article 299 of the Criminal Code,
- of a terrorist nature, referred to in Article 115 § 20 of the Criminal Code, or aimed at committing this offence,
- entrusting work to a minor foreigner referred to in Article 9(2) of the Act of 15 June 2012 on the effects of entrusting work to foreigners staying in the territory of the Republic of Poland contrary to the regulations (Journal of Laws, item 769),
- against economic turnover referred to in Articles 296-307 of the Criminal Code, the offence of fraud referred to in Article 286 of the Criminal Code, the offence against the reliability of documents referred to in Articles 270-277d of the Criminal Code, or a fiscal offence,
- referred to in Article 9(1) and (3) or Article 10 of the Act of 15 June 2012 on the effects of entrusting work to foreigners staying in the territory of the Republic of Poland contrary to the regulations
– or for the relevant criminal act as defined by foreign law;
b) if an incumbent member of its management or supervisory body, a partner in a general or partnership company or a general partner in a limited partnership or a limited joint-stock partnership or a proxy has been convicted of a criminal offence,

Grounds for exclusion from the proceedings c.d.
c) against which a final court judgment or a final administrative decision on arrears in the payment of taxes, fees or social security or health contributions has been issued, unless the Contractor has made a binding agreement before the deadline for submitting applications to participate in the proceedings or before the deadline for submitting tenders, respectively on the payment of those debts;
(d) who has been finally prohibited from competing for public contracts;
e) if the Contracting Authority may determine, on the basis of credible indications, that the Contractor has concluded an agreement with other Contractors aimed at distorting competition, in particular if, belonging to the same capital group within the meaning of the Act of 16 February 2007 on competition and consumer protection, they submitted separate offers, partial bids or requests to participate in the procedure, unless they show that they have prepared those offers or requests independently of each other;
f) if, in the cases referred to in Article 85(1) of the Public Procurement Law, there has been a distortion of competition resulting from the previous involvement of the Contractor or entity that belongs to the same capital group with the Contractor within the meaning of the Act of 16 February 2007 on competition and consumer protection, unless the resulting distortion of competition can be eliminated in a different way than by excluding the Contractor from participation in the procurement procedure.
3. On the basis of Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine. EU nr L 229, 31.7.2014, p. 1), i.e.: the award or continued performance of any public contract falling within the scope of the Public Procurement Directives, as well as Article 10(1), (3), (6)(a) to (e), (8), (9) and (10), Articles 11, 12, 13 and 14 of Directive 2014/23/EU, Articles 7 and 8, shall be prohibited, points (b) to (f) and (h) to (j) of Article 10 of Directive 2014/24/EU, Article 18, points (b) to (e) and (g) to (i) of Article 21, Articles 29 and 30 of Directive 2014/25/EU and points (a) to (d), (f) to (h) and (j) of Article 13 of Directive 2009/81/EC for or with:
(a) Russian nationals or natural or legal persons, entities or bodies established in Russia;
(b) legal persons, entities or bodies whose ownership rights are directly or indirectly owned by an entity referred to in point (a) of this paragraph for more than 50 %, or
(c) natural or legal persons, entities or bodies acting on behalf of or at the direction of an entity referred to in points (a) or (b) of this paragraph, including subcontractors, suppliers or entities whose capacities are relied on within the meaning of the Public Procurement Directives, where they account for more than 10 % of the contract value.
Part VII – Delivery of 49 portable slurry pumps with accessoriesThe subject of Part VII is the supply of 49 pieces of portable slurry pumps with accessories. The kit includes the following items:

Grounds for exclusion from the proceedings c.d.
4. The following shall be excluded from the procurement procedure (Article 7(1) of the Law on special arrangements for counteracting support for aggression against Ukraine and for the protection of national security):
(a) an economic operator included in the lists set out in Council Regulation (EC) No 765/2006 of 18 May 2006 concerning restrictive measures in view of the situation in Belarus and the participation of Belarus in Russia's aggression against Ukraine (OJ 2006). UE L 134, 20.05.2006, p. 1, as amended. as amended), hereinafter referred to as Regulation No 765/2006 and Council Regulation (EU) No 269/2014 of 17 March 2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (OJ 2014). UE L 78, 17.03.2014, p. 6, as amended. as amended), hereinafter referred to as Regulation No 269/2014 or entered on the list of persons and entities subject to measures in the form of exclusion from the public procurement procedure, on the basis of a decision on entry on the list deciding on the application of a measure in the form of exclusion from the public procurement procedure conducted on the basis of the Public Procurement Law;
b) a contractor whose beneficial owner within the meaning of the Act of 1 March 2018 on counteracting money laundering and terrorist financing (Journal of Laws of 2022, items 593 and 655) is a person listed in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a beneficial owner from 24 February 2022, provided that it has been entered on the list on the basis of a decision on inclusion on the list deciding on the application of a measure in the form of exclusion from a public procurement procedure conducted on the basis of the Public Procurement Law;
c) a contractor whose parent company within the meaning of Article 3(1)(37) of the Accounting Act of 29 September 1994 (Journal of Laws of 2021, items 217, 2105 and 2106) is an entity listed in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a parent company from 24 February 2022, provided that it has been entered on the list on the basis of a decision on entry on the list deciding on the application of a measure in the form of exclusion from the public procurement procedure conducted on the basis of the Public Procurement Law.
5. Pursuant to Article 7(2) of the Law on special arrangements for counteracting support for aggression against Ukraine and for the protection of national security, exclusion from the proceedings shall take place for the duration of the circumstances referred to in point 3. Pursuant to Article 7(3) of the aforementioned Act, in the case of a contractor excluded on the basis of point 3, the Contracting Authority rejects the bid of such a contractor, does not conduct negotiations with such a contractor and does not invite it to submit an additional bid.
Part VIII – Delivery of 45 portable slurry pumps with accessoriesThe subject of Part VIII is the delivery of 45 pieces of portable slurry pumps with accessories. The kit includes the following items:

Grounds for exclusion from the proceedings c.d.
6. The contracting authority provides for the following optional condition for exclusion from the procedure, i.e. the condition specified in Article 109(1)(4) of the Public Procurement Law, i.e. the contracting authority shall exclude from the procurement procedure a contractor in relation to which liquidation has been opened, bankruptcy has been declared, whose assets are managed by a liquidator or court, has concluded an arrangement with creditors whose business activity is suspended or is in another situation of this type resulting from a similar procedure the place where the procedure is initiated, as provided for in the legislation.
7. The Contractor may be excluded by the Contracting Authority at any stage of the procurement procedure.
8. Pursuant to Article 110(2) of the Public Procurement Law, the Contractor shall not be excluded in the circumstances specified in Article 108(1)(1), (2) and (5) and Article 109(1)(4) of the Public Procurement Law if it proves to the Contracting Authority that it has met all of the following conditions:
(a) has made good or undertaken to make good the damage caused by his crime or misconduct, including pecuniary compensation;
b) fully explained the facts and circumstances related to the crime or his or her wrongdoing and the damage caused by it, actively cooperating with the competent authorities, including law enforcement authorities, or the Contracting Authority, as appropriate;
(c) has taken specific technical, organisational and personnel measures appropriate to prevent further criminal offences or wrongdoing, in particular:
- severed all links with persons or entities responsible for the Contractor's misconduct,
- reorganised the staff,
- has implemented a reporting and control system,
- set up internal audit structures to monitor compliance with laws, regulations or standards,
- introduced internal regulations regarding liability and compensation for non-compliance with regulations, internal regulations or standards.
9. Pursuant to Article 110(3) of the Public Procurement Law, the Contracting Authority shall assess whether the actions taken by the Contractor referred to in point 8 are sufficient to demonstrate its reliability, taking into account the gravity and special circumstances of the Contractor's act. If the actions taken by the Contractor referred to in point 8 are not sufficient to demonstrate its reliability, the Contracting Authority shall exclude the Contractor.
10. Pursuant to Article 111 of the Public Procurement Law, the Contractor is excluded:
a) in the cases referred to in Article 108(1)(1)(a) to (g) and (2) - for a period of 5 years from the date on which the judgment confirming the existence of one of the grounds for exclusion has become final, unless a different period of exclusion has been specified in that judgment;
b) in the cases referred to in Article 108(1)(1)(h) and (2) of the Public Procurement Law, when the person referred to in these provisions has been convicted of an offence listed in Article 108(1)(1)(h) of the Public Procurement Law – for a period of 3 years from the date on which the judgment confirming the existence of one of the grounds for exclusion becomes final, respectively, unless a different period of exclusion is specified in the judgment;
c) in the case referred to in Article 108(1)(4) of the Public Procurement Law - for the period for which the ban on bidding for public contracts has been finally adjudicated;
