The order concerns a comprehensive supply of electricity, which includes its sale and distribution for 79 consumption points of the Municipality of Międzyzdroje and its organizational units for the period 21.05.2023 - 20.05.2025 with the total volume of demand, in the period covered by the contract 1366204 kWh, for facilities and all units participating in the proceedings, In connection with the need to ensure the continuity of electricity supply for street lighting, squares, points and facilities located in the Municipality of Międzyzdroje, Taking into account the above and the approaching end of the previous contract for such a service – needs to announce an order for the next period.
Street lighting and all necessary points used by residents and employees of the office is necessary for the proper and, above all, safe functioning of residents and guests visiting the Międzyzdroje Commune.
1 The order concerns a comprehensive supply of electricity, which includes its sale and distribution for 79 consumption points of the Municipality of Międzyzdroje and its organizational units for the period 21.05.2023 - 20.05.2025 with a total volume of demand, in the period covered by the contract 1366204 kWh, for facilities and all units participating in the procedure, listed in Annex 1 to this application.
2 The estimated time of delivery of electricity may change depending on the course of the public procurement procedure and/or the change of supplier procedure.
3 Place of implementation: Municipality of Międzyzdroje, according to the list of collection points set out in the Annex.
4 Planned consumption of electricity at individual points of consumption, hereinafter referred to as "PPE", existing contractual capacities, tariff groups, Appendix No. 2.
5 The forecast electricity consumption in individual PPE is indicative for the preparation of the offer and may change during the term of the contract, but it does not constitute the Ordering Party's obligation to purchase electricity in the given quantity. The change in consumption will not result in additional costs for the Ordering Party, except for the settlement for the actual amount of energy consumed according to the prices given in the offer. The measurement of the electricity consumed will be carried out by means of metering and settlement systems owned by the Distribution System Operator, hereinafter referred to as "DSOs".
6 The contractor should take into account the fluctuation of electricity consumption at the level of ±15% in total for the entire volume. In this respect, the Contractor may not lodge any additional claims. The remuneration in this respect will be calculated according to the rates specified in the submitted offer.
7 The performance of the contract will take place under the conditions laid down in the Law of 10 April 1997. Energy law, executive regulations to this Act and generally applicable legal regulations.
8 The Contractor is obliged to ensure the quality parameters of electricity in accordance with the applicable provisions of law.
9 All organisational units referred to are eligible customers referred to in Article 2(2)(d) and (e) of the Act of 27 October 2022 on measures aimed at limiting electricity prices and supporting certain customers in 2023 (Journal of Laws of 2022, item 2243), which means that the maximum price of electricity for which the Contracting Authority will settle with the Contractor in the period from the date of signing the contract until 31.12.2023. is PLN 0.785 kWh (net). The contracting authority submitted to the entitled entity an appropriate statement referred to in Article 5(1) of the aforementioned Act.
10 Currently, the Contracting Authority has a Comprehensive Agreement covering the sale of electricity and the provision of distribution services, concluded with Enea Spółka Akcyjna with its registered office in Poznań, Górecka 1, 60-201 Poznań.
11 The Contractor's obligations shall also include completing all formalities and arrangements with the existing electricity supplier in order to maintain liquidity in the supply of energy and not to cause interruptions in the power supply, including those related to the change of supplier. By the date of signing the contracts, the Ordering Party shall provide an appropriate power of attorney to submit notifications of the sales contract on behalf of the Ordering Party and to perform the activities necessary to carry out the process of changing the seller.
12 All actions shall be taken by the Contractor without undue delay, enabling the commencement of electricity delivery at the first possible date after the effective procedure of changing the seller, taking into account the complaint submission process in the event of negative verifications of the notification.
13 The Contractor shall be responsible for the whole, including the course and timely performance of the contract. The Ordering Party expects high quality and diligence, compliance with the technical and quality conditions of the subject of the contract.
