The subject of the order is to be new, admitted to trading on the basis of applicable law and meet all requirements specified by law, in particular the Act of 6 September 2001 Pharmaceutical Law (i.e. Journal of Laws of 2022, item 2301, as amended), free from any physical or legal defects and have an expiry date on the day of delivery, not less than 12 months.
5. The technical parameters given in the Annexes shall be considered as a model satisfying the minimum requirements. The elements proposed by the Contractors may not have parameters worse than those given as a model.
6. An equivalent product is a product with the same chemical composition, which also means that the active substance must be present in the same chemical compound, the same dosage, the same therapeutic indications, the same form and the same pharmacokinetic properties.
7. If the trade name of the company, product or product is indicated in the tender documentation, the Ordering Party shall allow equivalent solutions in accordance with the technical data and parameters contained in the documentation. If the Contracting Authority allows solutions equivalent to those described in the documentation attached to the SWZ, but does not provide minimum parameters that would confirm this equivalence – the Contractor is obliged to offer a product with similar properties, functionally suitable for the required application (arg. based on the operative part of the judgment of the National Appeal Chamber of 14 October 2013 [file reference: KIO 2315/13]). The Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the supplies offered by it meet the requirements specified by the Contracting Entity.
NOTE: Its own name is the name under which the item marked by it occurs (or would occur) both in Poland and in other countries.
8. If the Ordering Party describes the subject of the contract by means of standards, approvals, technical specifications and reference systems, the Ordering Party shall allow solutions equivalent to those described. The Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the supplies offered by it meet the requirements specified by the Contracting Authority

of 20 February 2009 on the requirements for the labelling of medicinal product packages and the content of leaflets (i.e.: Journal of Laws of 2020, item 1847).
10. Information on the prior evaluation of offers, in accordance with Article 139 of the Public Procurement Law. The selection of the most advantageous offer will be made using the so-called "reverse procedure". The contracting authority will first examine and evaluate the bids, and then it will make a subjective qualification of the Contractors whose bids have been rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.

2. The entire assortment should have certificates confirming admission to marketing in the Polish.
3. The order was divided into 28 sets (parts). Partial tenders may be submitted for individual sets. All of the listed items must be offered as part of the set. Failure to complete any item within the set will result in rejection of the offer.
