2. Part 2 of the order — purchase of electricity for the facilities listed in Annex 2 to the SWZ — other facilities:
The planned amount of electricity is 1 262 668 kWh

3. The contracting authority envisages awarding this contract divided into lots:

The forecasted electricity consumption for Lot No. 1 and No. 2 is indicative, used to compare offers and in no case constitutes an obligation on the part of the Ordering Party to purchase energy in the given amount. The Seller shall not be entitled to any claim for failure to consume the expected amount of energy by the Ordering Party. Any change in the expected estimated consumption will not result in additional costs for the Ordering Party, except for the actual amount of energy consumed according to the prices specified in the offer.
4. A detailed description of the subject of the contract is included in Annexes 1 and 2 to the SWZ, which is an integral part of this SWZ.
5. The supply of electricity shall be carried out in accordance with the principles set out in the Act of 10 April 1997. Energy Law (consolidated text) Journal of Laws of 2022, item 1385, as amended), hereinafter referred to as the "Energy Law" and in executive acts issued on its basis, with specific quality standards. Electricity quality standards are described in the Energy Law, in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819), in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of shaping and calculating tariffs
6. During the term of the contract, at the request of the Contracting Entity, it is possible to increase the number of objects listed exhaustively in Annex 1 to this SWZ. It is expected that the number of new facilities may not exceed 20% of the number of objects indicated in Annex 1 to the SWZ – zad. No. 1 and No. 2.

7. The Ordering Parties reserve the right to withdraw from the sales contract for facilities in which, due to the implementation of RES installations, it will be necessary to conclude a comprehensive agreement.
8. Electricity should meet quality service standards in accordance with the provisions of the Energy Law and executive regulations to this Act. In the event of failure to meet quality service standards, the ordering party, at its written request, has the right to discounts at the rates specified in the Regulation of the Minister of Economy of 6 March 2019 on the detailed rules for shaping and calculating tariffs and settlements in electricity trading (i.e. Journal of Laws, item 2505
