Financing, planning, construction and maintenance of a new litigation building for the Bonn Regional Court
The state of North Rhine-Westphalia (NRW), represented by the Ministry of Justice of the State of North Rhine-Westphalia, represented by the President of the Cologne Higher Regional Court (client), intends to build a new court building in Siegburg. The need for the new building is due to the significant additional need for room space available at short notice for commercial criminal proceedings in the district of the Bonn Regional Court triggered by the cum-ex share transactions. To protect the interests of the judiciary of the state of North Rhine-Westphalia, the building must be occupied by the Bonn Regional Court (user) by March 2024 at the latest. Due to this urgency, solutions using prefabricated parts/modular constructions or a high level of prefabrication are also expressly permitted. The property to be built is spatially related to the existing legal location of the Siegburg District Court and is owned by the state of North Rhine-Westphalia. The land plot will be made available free of charge for construction. The new building is to be financed, planned, erected and maintained by a contractor for 15 years. The requirements of the customer must be taken into account during planning and setup.
The room program of the process building comprises three rooms with 2 x 220 m² and 1 x 300 m² net room area (NRF) plus a screening center to be provided for criminal proceedings and other function rooms used for room operations. The required program area, defined by the room program, comprises a total of around 1,250 m². The building volume can be accommodated in a structure with two full floors and a gross floor area (GFA) of approximately 3,500 m².
The contractor has to take over services for the maintenance of the building and the outdoor facilities (maintenance, inspection and repair) for 15 years. From acceptance, the contractor receives an annual service fee from the client to refinance his investment costs as well as for operation and maintenance measures. The contractor will receive this service fee over a period of 15 years. Forfaiting with waiver of objection is envisaged for financing.
