The services concern a global project aimed at the infrastructure of the Rose Garden. It is an area of 1.5 hectares including different buildings (footprint of nearly 2200 m²) which belongs to the municipality of Saint-Gilles but is located in Uccle. It hosts a multitude of activities (homework school, playgrounds organized by the municipality, training, etc.) the main ones being offered by the non-profit association "La Roseraie – Espace Cré-Action" which has been developing for 23 years a place of residence and artistic creation for young audiences and circus arts. The buildings, some of which, from the modern movement, are of real architectural interest, require an energy renovation (insulation of the envelope and renovation of the technical installations) and compliance. This work, claims a subsidy under the European recovery plan and, in the case of a confirmation of this subsidy, should be received by June 2026. In addition, users want to see one (or more) extension(s) realized in order to develop their activities. The program includes, among other things, a multipurpose foyer to accommodate 130 people and two performance/rehearsal rooms with 130 and 150 seats (estimated increase of 270m² net). It is also necessary to rethink the layout of reception areas for visitors and artists, reorganize the offices of the non-profit organization and rethink the outdoor spaces. This overall project is divided into 3 components, only the first of which is guaranteed at the moment. See details in point II.2.4.
The services include the study and monitoring of the execution of the works for the aforementioned project. They are structured around 9 required skills, at least:
• At the request to participate stage, only the architectural competency is requested and therefore evaluated. Pursuant to Article 8§2 of the Law of 17 June 2016, the candidate will include (all) the economic operator (s) whose capacity is mobilized to satisfy the selection conditions (minimum specific levels required) relating to technical and professional capacity. These economic operators cannot therefore be third parties (subcontractors, consultants, etc.), except partners or collaborators with relevant previous experience, under the conditions set out in point III.1.3). When a candidate has several economic operators, they form what is called a “GROUPING”. Responsibility (for the request for participation and, if necessary, for the offer and the mission) is shared between these economic operators. A mandate is given to one of the operators of the group, called “AGENT”: the latter has the signing power and represents the group vis-à-vis the adjudicator. The candidate alone or the representative of the group will be responsible, in whole or in part, for the architectural competence. ATTENTION: pursuant to Article 54 of the Royal Decree of 18 April 2017 (§1) a candidate can only submit one request for participation per contract and (§2) a tenderer can only submit one tender per contract.
• In view of the production of the tenders and the execution of the contract, the successful candidates will also have to assume 8 additional skills (stability, special techniques, EPB, acoustics, furniture design, signage design, landscape and scenography). Any skills deemed useful or relevant to the subject matter of the contract may then also be added. The tenderer may call on one or more third-party economic operator(s) (subcontractor(s), consultant(s), etc.) to assume these 8 additional skills required and any additional skills added to its initiative.
It will also be requested to make a proposal for collaboration with one (or more) artist(s) for the integration of a work of art, pursuant to the decree of 10.5.1984 on the integration of works of art in public buildings. This proposal will be formulated in the offer. The cost of the work and the artist's fees are not included in the budget envelope mentioned below.
The service of the health security coordinator is not the subject of this assignment.
The total budget of the works is estimated to date at 3,740,000.00 EUR, excluding VAT and fees. The fees are calculated on the basis of a flat-rate percentage of the total amount of the work (final statement), all skills combined (skills required + any skills added on the initiative by the tenderer).
The mission will have three components:
The implementation of Component 1 is a priority. That of Strands 2 and 3 is more hypothetical because it is more dependent on obtaining additional funding (subsidies, etc.).
* COMPONENT 1:
1.a :
Complete mission of energy renovation of buildings E and F (Large building and Courtyard):
- the estimated amount of work relating to this component is EUR 1,700,000, excluding VAT and fees;
- the rate of fees applicable to this component is 10%;
- the estimated amount of fees relating to this component is EUR 170,000, excluding VAT.
1.b :
Preliminary sketch on Components 2 (energy renovation of buildings A, B, C and D and pavilions 3 and 4) and 3 (extension and landscaping of the site): fee package of 17,000 euros excluding VAT. As this preliminary outline constitutes an advance in the work expected under the subsequent components, the related fees will be deducted from the fraction of fees provided for the said stage in Components 2 and 3.
* STRAND 2 (conditional on the mobilisation of additional financing):
Complete mission of energy renovation of buildings A, B, C and D (reception buildings) and pavilions 3 and 4:
- the estimated amount of work relating to this component is EUR 740,000, excluding VAT and fees;
- the rate of fees applicable to this component is 10%;
- the estimated amount of fees relating to this component is EUR 69,000, excluding VAT, i.e. 10% of the amount of the works from which EUR 5,000 excluding VAT is deducted corresponding to the proportion of the preliminary sketch requested under component 1.
* STRAND 3 (conditional on the mobilisation of additional financing):
Complete mission of extension and landscaping of the site:
- the estimated amount of work relating to this component is EUR 1,300,000, excluding VAT and fees;
- the rate of fees applicable to this component is 13%;
- the estimated amount of fees relating to this component is EUR 157,000 excluding VAT, i.e. 13% of the amount of the works from which EUR 12,000 excluding VAT is deducted corresponding to the proportion of the preliminary sketch requested under component 1.
In accordance with the practices of the sector, the services related to a complete mission of study and monitoring of the execution of works are conventionally governed by means of a tranche contract within the meaning of Article 57 of the Law of 17 June 2016 on public contracts and certain works, supply and service contracts: each classic slice corresponding to a stage of the classic architectural mission (sketch, preliminary project, permits, ...);
To facilitate reading and execution, these tranches will be, in the specifications, called "STADES", but are to be considered as tranches within the meaning of the Law on public procurement.
Each tranche benefits from an order (service order, a receipt and a payment of its own). Only the first phase (including the sketch stage on Strand 1a and the entire strand 1b) is firm. All other tranches of the market are conditional. The execution of each conditional instalment shall be subject to a decision of the contracting authority.
ATTENTION :
Given that the project claims a subsidy under the recovery plan, the work on components 1 and 2 should, if the grant is awarded, be received by June 2026. This objective is theoretically achievable but very fair and does not allow margins to be set aside for the many unforeseen events typically affecting infrastructure projects (extension of deadlines for planning permission, bad weather on site, etc.). Therefore, in the case of a situation of law external to the contracting authority which makes it necessary to reduce the ordinary minimum time limit, the advertising periods for the present procedure for the award of the service contract may be reduced up to 15 days for the receipt of requests to participate and up to 10 days for the receipt of tenders in accordance with Article 37, §4, 1° and 2° of the Public Procurement Act.
In general, the attention of candidates is drawn to the very tight schedule of this procedure. Candidates are therefore asked to take this constraint into account and not to engage in the procedure if they fear that, in the event of selection, they will not be able to submit an offer for lack of time.
