Description:

Successive supplies of diesel oil and heating oil for Przedsiębiorstwo Usług Komunalnych Sp. z o. o. in Ciechanów for the years 2019-2020 divided into the following tasks:

1. Task I

Supply of diesel oil to a tank located in the landfill site in Wola Pawłowska in the Ciechanów commune in an amount of up to 500,000 liters with parameters specified by the Polish Standard PN-EN 590 with as amended, taking into account parameters in summer and winter, depending on weather conditions, other parameters in accordance with the relevant regulation on the quality requirements for liquid fuels.

1) Requirements for the Contractor:

a) The Contractor should provide diesel fuel in accordance with current requirements of regulations governing the manner of transporting fuel

b) The Contractor is responsible for the quality of the fuel supplied and is obliged to present, together with the delivery, the current fuel quality certificate, certified by the manufacturer or attestation of an accredited laboratory, in Polish. The certificate should be associated with the delivery or issue note by placing the number and date of delivery or issue on it.

c) The Contractor must ensure the Employer continuity of supplies during the contract period and guarantee the implementation of one-off deliveries within max. 24 hours from the notification of such need by the Employer sent by post, fax or telephone.

d) the maximum one-time supply of diesel oil to the tank located in the landfill site in Wola Pawłowska is up to 5,000 liters, and deliveries will be made gradually according to the needs of the Employer at least 4 times a month.

e) The Contractor shall, at his own expense and risk, provide the quantities of diesel oil ordered by the Employer with his own transport to the tank located at the landfill site in Wola Pawłowska commune Ciechanów (aboveground tank) from Monday to Friday from 7:30 to 14:30.

f) The Contractor undertakes that with each delivery, the loading and unloading crates in road tankers will be sealed

g) At the first delivery, the Contractor undertakes to provide a Material / Preparation Characteristics Card issued in accordance with applicable regulations and regarding ON which is the subject of the sale.

3. The Purchaser reserves the right to carry out prior to unloading the road tanker a preliminary check, including:

a) checking if the tanker truck has no traces of leaks,

b) checking the condition and cleanliness of the tanker's drain lines.

c) checking if the tanker truck complies with the general health and safety and fire protection regulations.

d) taking fuel samples from the tank drain valves to make a visual assessment of whether the fuel is clear, without suspensions, solids or water deposits.

4. Receipts of supplied diesel oil will be made based on the indications of the Employer's control and measurement system in liters in the Employer's tank before and after unloading the road tanker, by the Employer's representatives with the participation of the Contractor's representatives, after prior checking the Contractor's seals installed on the tanker's loading and unloading boxes.

5. Quantitative settlements of delivery will be based on volume units at actual temperature.

6. The Purchaser reserves the right to refuse to accept a delivered product in the event of:

a) confirmation of the lack of documents referred to in point 3 point 2b, or presenting incomplete or incorrect documents.

b) reservations resulting from the initial control referred to in item 3 point 3, in particular in the event of the presence of water or foreign impurities in the sampled fuel.

c) in the event of refusal to accept the product by the Employer, the Contractor is obliged at his expense within 24 hours to provide the Employer with the same amount of diesel oil that meets the requirements set out in point 3 item 1 of these ToR.

7. The Contractor shall provide the Employer with persons who will be authorized to contact and determine details of the performance of the contract, providing their contact details.

8. The Purchaser reserves the right not to use the full amount of demand during the contract period.

9. The Contractor shall not be entitled to any claims against the Employer for failing to purchase the maximum amount of oil.

2. Task II

Supply of light heating oil in an estimated amount of up to 80,000 liters to an oil boiler room located in the RZGOK building in Wola Pawłowska.

1) Fuel oil must meet the quality parameters that meet the requirements of the Regulation of the Minister of Economy of 3 November 2014 on the quality requirements for sulfur content for oils as well as types of installations and conditions in which heavy fuel oils will be used (Journal of Laws item 1547) and Polish Standard PN-C-96024: 2011 and have the following minimum parameters:

- density: at 15 about C - max. 0.860 kg / l

- calorific value not less than 42.6 MJ / kg

- sulfur content max. 0.1%

- solids content not exceeding 24 mg / kg

- water content max. 200mg / kg

2) Oil deliveries will be made gradually according to the needs of the Employer.

3) The Purchaser reserves the right not to use the full amount of demand during the contract period.

4) The Contractor shall not be entitled to any claims against the Employer for failing to purchase the maximum amount of oil.

5) Method of delivery:

• The Contractor will be obliged to deliver the subject of the contract successively for the duration of the contract at unit prices, in accordance with the Offer Form

• The Purchaser will determine the size and date of each delivery according to current needs by submitting an order to the Contractor. Delivery will take place within max. 24 hours from the date of notification by the Employer.

• Orders will be submitted to the Contractor by phone, fax or electronically.

• The Contractor shall, at his own expense and risk, provide the quantities of diesel oil ordered by the Employer with his own transport to the boiler room located in the landfill site in Wola Pawłowska commune Ciechanów from Monday to Friday from 7:30 to 14:30.

• The Contractor will be obliged to notify the Purchaser by phone about the preparation of the goods for release, in advance of the agreed delivery date.

• The Contractor will be required to provide a current heating oil quality certificate with each delivery of heating oil.

• The fuel will be received and invoiced according to the quantity measured at the actual temperature based on the tank meter reading.

6) The Contractor shall provide the Employer with persons who will be authorized to contact and determine the details of the performance of the contract, providing their contact details.
