The subject of the contract includes the successive collection and management of waste in the recovery or recycling process in accordance with the Act of 14 December 2012 - on waste (Journal of Laws of 2022, item 699) of biodegradable waste with code 20 02 01.

b) The method and place of management of the collected waste must comply with the applicable provisions of law, in particular with the requirements of the above-mentioned Act and its implementing regulations.

c) Waste code 20 02 01 (biodegradable waste) will come from separate collection from property owners and from mowing streets and parks.

d) Collection of waste with the code 20 02 01 will take place from the premises of Zakład Gospodarki Komunalnej Sp. z o.o. in Zawiercie from Monday to Friday, from 6.00 to 20.00, transport of the Contractor and at his expense.

e) The Contractor is obliged to timely collect and transport the waste to the place of the final management no longer than within 48 hours from the moment of notification of receipt by the Ordering Party. Loading of waste belongs to the Ordering Party.

f) Weighing of the received components will take place on the Ordering Party's scales, located in the ZGK in Zawiercie and will be preceded each time by the generation of a waste transfer card in the electronic BDO system. The Contractor will each time confirm in the electronic BDO system the amount of waste collected for management with the code 20 02 01.

g) At the time of transfer of waste by the Ordering Party to the Contractor, the Contractor assumes responsibility for the seized waste, for proper handling of it and for the consequences resulting from it.

h) The Contractor is obliged to subject the entire mass of waste transferred to it with the code 20 02 01 to the processing processes in its installation and on the basis of its permit for the processing of waste in the R3 recovery process.

i) The Contractor undertakes to use the following as a result of the processing referred to in point h) above "starting material":

- if as a result of waste processing code 20 02 01 a compost that does not meet the requirements is formed, then as waste with code ex19 05 03 it will be transferred to the recovery process R10, in accordance with the conditions set out in the Regulation of the Minister of the Environment of 20 January 2015 on the recovery process R10;

- if as a result of waste processing code 20 02 01 a soil improver is created, then it will be placed on the market on the basis of the decision of the Minister of Agriculture held by the Contractor, allowing the marketing of a soil improver.

j) The collected waste will not be returned.

k) The Contractor shall prepare and provide the Contracting Authority with a written confirmation of subjecting the collected waste to the recovery/recycling process within 14 days of receipt of each waste batch. The installation for recovery or recycling of the waste in question must meet the requirements set out in the Act of 14 December 2012 - on waste (Journal of Laws of 2022, item 699).

l) The contractor shall have transport units adapted to the transport of waste and have permanent safeguards to prevent the waste from being blown or spilled out during transport.

(m) Waste derives from direct separate collection of waste. The Contracting Authority is not able to determine the quantitative, qualitative and morphological parameters guaranteed by the Contracting entity of waste transferred to the Contractor under this contract. Therefore, the Contractor may not pursue any claims against the Ordering Party in this respect.

n) On the basis of weighing evidence generated by the Ordering Party, settlements with the Contractor will take place. The unit price for 1 Mg calculated by the Contractor will be the basis for determining the amount due for the amount of waste actually collected in a given month. The unit price will include all costs, including m.in costs of transport and waste management.
