The subject of the order is the sale of electricity for the purposes of ZWiK Ciechanów with a total estimated volume of 4,200 MWh, including: Tariff Group B23: Pre-South Peak - 700 MWh, Afternoon Peak - 400 MWh, Other hours of the day - 2500 MWh; Tariff Group C12A: Peak Zone - 170 MWh, non-peak zone — 430 MWh, and the purchase of electricity generated in the RES of the Ordering Authority biogas power plant with a capacity of 0.5 MW, with an estimated volume of 60 MWh together with the trade balancing service. The detailed scope of the contract, i.e. the list of facilities in the ZWiK in Ciechanów, the annual estimated consumption and planned sales of electricity shall be determined by Annex No 1 to the SWZ.
The sale of electricity for own and generated needs will be carried out under the conditions laid down by the Act of 10 April 1997 — Energy Law (i.e. Journal of Laws of 2021, item 716 as amended) and in accordance with the implementing provisions issued thereto, in particular with the regulations issued to that law. quality standards of customer service set out in the Regulation of the Minister of Economy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and billing in the trading of electricity (Journal of Laws of 2019 item 503 as amended).
The detailed scope of the contract, i.e. the list of facilities in the ZWiK in Ciechanów, the annual estimated consumption and planned sales of electricity shall be determined by Annex No 1 to the SWZ.
Distribution services will be provided under a separate agreement concluded by the Ordering Party for the PPE in question with the Distribution System Operator (DSO), i.e. Energa — Operator S.A. with its registered office in Gdańsk, subject to point 4.5 below.
The Contracting Authority reserves the right to reduce or increase the amount of power for its own and generated in respect of the quantity referred to in point 1 above, caused by a duly reduced or increased electricity demand or reduced or increased accordingly production of electricity. Any change in the estimated consumption referred to in point 1 will not result in additional costs for the Contracting Authority, other than the settlement for the amount of electricity actually consumed or generated according to the prices specified in the Agreement. The existence of the circumstances referred to in the first sentence will result in a corresponding reduction or increase in the remuneration payable to the Contractor and the Contracting Authority.
The basis of the billing will be the quantities resulting from indications of measurement and billing systems installed in the facilities and made available to the Contractor by the DSO.
The Contractor shall, on behalf of and for the benefit of the Contracting Authority, by virtue of the generic power of attorney granted, carry out the procedure for changing the seller and establishing the entity responsible for balancing the POB.
The Contracting Authority shall grant the Contractor a power of attorney to notify, on behalf of the Contracting Authority, the contract of sale to the Distribution System Operator in order to implement the contractual contract for the sale of electricity and to represent the Ordering Party in the process of changing the seller.
The Contractor undertakes to balance the commercial balance of the Ordering Party and act as the entity responsible for the trade balancing of the URD and to report that fact to the relevant Distribution System Operator.
The Contractor shall have an appropriate contract for the provision of electricity distribution services concluded with the Distribution System Operator to which the networks are connected by the Contracting Authority's PPE as defined in Annex No 1 to the SWZ, enabling the sale of electricity to the Contracting Authority for the purposes of own and the purchase of electricity generated in the installation of the Ordering Authority's RES.
The Contracting Authority shall inform that in accordance with paragraph. A.3.5 of the Traffic and Operation Instructions of the Distribution Network ENERGA-OPERATOR S.A.: “POB shall be indicated by the seller and the company engaged in electricity generation, in the contract for the provision of distribution services. The billing resulting from the imbalance of electricity supplied and extracted from the system, for a given energy consumption point (PPE), shall only be made by one POB.”
Annex 1 to SWZ informationally identifies the parameters for the PPE point that may differ from those currently in force or may be subject to change during the course of the contract for the sale of electricity within the tariff groups included in the SWZ.
The Contracting Authority informs that the measurement systems for tariff B23 are aligned with TPA rules.
The Contracting Authority reserves the possibility of increasing or reducing contractual power for individual PPE of the Contracting Authority during the course of the contract with the Contractor whose offer has been chosen as the most advantageous.
