Round-the-clock physical protection of persons, property and real estate of the Contracting Authority, as well as counteracting threats by the licensed Contractor, based on the provisions of the Act of 22.08.1997 on the protection of persons and property (Journal of Laws of 2021, item 1995), at the headquarters in Tychy, at 2 Fabryczna Street

1. Round-the-clock physical protection of persons, property and real estate of the Contracting Authority, as well as counteracting threats by the licensed Contractor, based on the provisions of the Act of 22.08.1997 on the protection of persons and property (Journal of Laws of 2021, item 1995), at the registered office in Tychy, at 2 Fabryczna Street

2. The place of execution of the order is the headquarters of the Katowice Special Economic Zone S.A., Tychy Subzone in Tychy (43-100), at 2 Fabryczna Street together with the external area.

3. A list of security posts can be found in the Terms of Reference (ToS) point 5(3)

4. A detailed description of the subject matter of the contract is attached as Appendix 1 to the agreement "Detailed scope of tasks of security personnel in the KSSE S.A., at its registered office in Tychy, 2 Fabryczna Street".

5. The Contractor is obliged to perform the contract on the terms and conditions described in the draft contract, which is attached to the Terms of Reference.

6. The performance of the services referred to in point 1 requires the Contractor to employ 11 people (10.7 FTEs) on the basis of an employment contract, due to the fact that the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Labour Code Act of 26 June 1974 (Journal of Laws of 2023, item 1465). Legal basis: Article 95(1) of the Public Procurement Law.

If the Contracting Authority becomes aware of the employment of employees under contracts other than employment, the Contracting Authority may terminate the contract for the provision of services with a two-month notice period.
