According to § 52 (2) of the Lower Saxony Road Act (NSTrG), the duty to clean roads within the closed local situation, including local passages of federal, state and district roads, is the responsibility of the municipalities, insofar as this has not been imposed on the owners of the adjacent property (Section 52 paragraph 4 NStRG).
These street cleaning services (without winter service) of the velvet municipalities of Artland are now to be reawarded on 1/1/2022. The contract initially has a term of 2 years with an option to extend for another 2 years. After the two-year contract period has expired, the contractual relationship is tacitly extended by another year, unless this is terminated by one of the parties by June 30 of the previous year at the latest. The extension option is possible for a maximum of 2 more years, and therefore up to 31.12.2025 at the most. In this respect, there is no need to terminate as of December 31, 2025.
The road cleaning services to be provided consist of sweeping performance and waste disposal.
sweeping power:
The sweeping performance only includes dust-free cleaning of roads and gutters as well as park tracks. It is therefore not necessary to clean the parking tracks if and as far as these cannot be driven by parking vehicles, for example. An environmentally friendly sweeper is to be used for cleaning, which is suitable for self-absorbing, low-dust and quiet cleaning. The sweepers must comply with the accepted rules of technology.
waste disposal:
Waste disposal includes taking possession of the resulting waste goods and its proper disposal in accordance with the requirements of the Circular Economy Act (KrWG) and the Lower Saxony Waste Act (NabfG). For this purpose, a simplified proof of disposal must be provided by the contractor. Transportation free from legal and technical complaints is the responsibility of the contractor. All associated costs and risks — especially of a traffic-related nature — must be included in the disposal fee.
The amount of water required for dust-free street cleaning is provided by the local community for a fee. A possible removal from a hydrant must be agreed with the Bersenbrück water association.
The cleaning should be carried out on pre-determined weekdays. With 2 days a week, they should be delayed by at least 3 days. Cleaning should be started on time on the specified days that it is finished by 6 pm.
The object of the contract is the allocation of street cleaning services (without winter service) for roads located in the area of the Artland municipality in accordance with the attached street directory.
The basis for street cleaning are the articles of association on the cleaning of roads in the municipality of Artland and the regulation on the type, dimension and spatial extent of street cleaning in the municipality of Artland with street directory in connection with the fee statute (street cleaning fee statute) for street cleaning of the Artland.
The division of roads to be cleaned in the municipality of Artland is as follows:
— sweeper within the city of Quakenbrück (once a week): 29,633 m,
— sweeper within the city of Quakenbrück (twice a week): 29,072 m,
— sweeper within the municipality of Badbergen (twice a week): 2,172 m,
— sweeper within the municipality of Menslage (twice a week): 2,740 m,
— sweeper within the municipality of Nortrup (twice a week): 1,805 m.
The specified quantities are calculated approximately and are billed according to quantity. The local municipality of Artland reserves the right to add or delete roads at the same conditions at any time if necessary. A street directory for the Samtgemeinde Artland is attached as an appendix to the draft contract.
