1. The subject of the contract is services in the field of forest management as defined in Article 6 (1) (1) of the Act of 28 September 1991 on forests (text one: Journal of Laws of 2021 item 1275 as late as “Forests Act”) covering works in the field of harvesting and ripping of timber to be carried out on Bircza Forest District in 2022.

2. The scope of the subject matter of the contract shall include the total quantities of harvesting work and lumber plugs resulting from Annex 3 to the SWZ, which consist of:

1) Annex No 3.1. — size of works according to operations,

2. Annex No 3.2. — difficulty zones and break-off distances and coefficients of obstruction and zones and distances,

3. Annex No 3.3 — sortment system of timber harvesting;

4. Annex 3.4. — a statement of items not made available for machine-sourcing;

5) Annex No 3.5. — information on the use of possible logging technologies.

Details of the object of the order for logging and timber retraction are set out in Annex 3 (Annex 3.1. — 3.5, respectively, for the Package concerned) to the SWZ.

In order to confirm the fulfilment of the conditions for participation in the proceedings referred to in point 7.1. SWZ, the Contracting Authority shall, before selecting the most favourable tender, acting on the basis of Article 126 (1) of the PZP, call upon the Contractor, whose offer has been highest assessed, to submit within the time limit not less than 10 days, current at the date of submission of the following measures of evidence:

(a) a list of services performed, and in the case of recurring or continuous benefits, also exercised, during the last 3 years (back from the date on which the deadline for submission of tenders), and if the operating period is shorter, including their gross value, the subject (type of services performed), the dates of performance (dates of the day commencement and completion of services) and the entities for which services have been performed or are performed duly (the model list of services performed is Annex 9 to the SWZ).

If the Contractor relies on experience in the performance of services carried out jointly with other Contractors, the list referred to above concerns the services in which the Contractor directly participated and in the case of recurring or continuous benefits in which the performance of directly participated or participates.

(b) evidence specifying whether the Contractor indicated in the list of services to confirm the fulfilment of the condition for participation in the procedure for technical or professional capability in the field of experience has been performed or is duly performed,

The evidence referred to above is references or other documents drawn up by the entity to which the services were performed and in the case of recurring or continuous benefits, and if the Contractor for reasons independent of him is unable to obtain these documents — a declaration by the Contractor; in the case of recurring or continuous benefits, references or other documents proving their proper performance should be issued within the last 3 months (back from the date on which the deadline for submission of tenders expires).

(c) the information of the bank or the cooperative savings and credit bank confirming the amount of the financial resources or creditworthiness of the Contractor, during a period not earlier than 3 months prior to its submission,

If, for a reasonable reason, the Contractor cannot submit the evidence required by the Contracting Authority referred to in paragraph 9.2 (c) of the SWZ, the Contractor shall submit other measures of evidence required by the Contracting Authority which sufficiently confirms the fulfilment described by the Contracting Authority the condition of participation in the proceedings concerning the financial situation.

(d) a list of persons addressed by the Contractor for the performance of the public contract, in particular responsible for the provision of services, including information on their professional qualifications, the rights (if required), necessary for the performance of the public contract, and the scope of the activities they carry out and the information on the basis to dispose of those persons (the model list of persons referred by the Contractor for the execution of the contract is Annex No 10 to the SWZ),

(e) the list of technical equipment available to the Contractor for the performance of the public contract, together with information on the basis to dispose of those resources - (the model list of technical equipment available to the Contractor for the performance of the contract is Annex No 11 to the SWZ).

In order to confirm the absence of grounds for exclusion referred to in paragraphs 6.1. and 6.3 of SWZ, the Contracting Party shall, before selecting the most favourable tender, acting on the basis of Article 126 (1) of the PZP, invite the Contractor whose offer has been the highest rated, to lodge within the specified time limit, not less than 10 days, current at the date of submission of the following measures of evidence:

(a) information from the National Criminal Register in terms of:

(a) Article 108 (1) (1) and (2) of the PZP,

(b) Article 108 (1) (4) of the PZP concerning the ruling of the prohibition of applying for a public contract under a criminal measure,

(c) Article 109 (1) (2) (a) of the PZP,

(d) Article 109 (1) (2) (b) of the PZP concerning the punishment for the offence for which the penalty of custody is meted out,

(e) Article 109 (1) (3) of the PZP concerning the conviction of an offence or punishment for a misdemeanor for which the penalty of custody is meted out

- drawn up not earlier than 6 months before its submission,

(b) statements by the Contractor, in the scope of Article 108 (1) (5) of the PZP, of non-affiliation with the same capital group, within the meaning of the Act of 16 February 2007 on the protection of competition and consumers (text one. Journal of Laws of 2021, item 275), with another Contractor who has submitted a separate offer or partial offer, or statements of affiliation with the same capital group together with documents or information confirming the preparation of an offer or partial offer independently of another Contractor belonging to the same capital group - (the model of the Contractor's statement in the scope of Article 108 (1) (5) of the PZP on affiliation or non-affiliation of the same capital group is Annex No 7 to the SWZ),

(c) the certificate of the competent head of the tax office confirming that the Contractor is not in arrears with the payment of taxes and fees, within the scope of Article 109 (1) (1) of the PZP issued no earlier than 3 months prior to its submission and in the case of payment of taxes or fees, together with by certification, the Contracting Authority requests the submission of documents proving that prior to the expiry of the deadline for the submission of tenders, the Contractor has made payments of taxes or fees due together with interest or fines or has entered into a binding agreement on the repayment of those receivables,

(d) a certificate or other document of the relevant field organizational unit of the Social Insurance Undertaking or the relevant regional branch or the relevant field facility of the Agricultural Social Insurance Service confirming that the Contractor is not in default to the payment of contributions to social and health insurance, in the scope of Article 109 (1) (1) of the PZP issued not earlier than 3 months prior to its submission, and in the case of payment of social or health contributions, together with a certificate or other document, the Ordering Party requests submission documents proving that prior to the expiry of the deadline for the submission of tenders, the Contractor has made payments of due social or health contributions, together with interest or fines, or has entered into a binding agreement on the repayment of those receivables,

(e) the allowance or information from the National Court Register or from the Central Registration and Business Information, as far as Article 109 (1) (4) of the PZP, drawn up not earlier than 3 months prior to its filing, if separate provisions require entry in the register or records,

(f) the Contractor's statements on the actuality of the information contained in the statement referred to in Article 125 (1) of the PZP as regards the grounds for exclusion from the proceedings indicated by the Contracting Authority referred to in:

(a) Article 108 (1) (3) of the PZP,

(b) Article 108 (1) (4) of the PZP concerning the ruling of the prohibition of applying for a public contract under a preventive measure,

If the Contractor is established or domiciled outside the borders of the Republic of Poland, instead of:

1) the information from the National Criminal Register referred to in point 9.3 (a) of the SWZ - shall provide information from the relevant register, such as the judicial register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which The Contractor shall be established or domiciled, to the extent referred to in point 9.3. (a) of SWZ,

2) the certificate referred to in point 9.3. (c) of the SWZ, a certificate or any other document proving that the Contractor is not in default to the payment of the social or health contributions referred to in point 9.3. (d) of the SWZ, or the allowance or information from the National Court Register or from the National Court of Law The Central Business Registration and Information referred to in point 9.3. (e) of the SWZ - shall submit a document or documents issued in the country where the Contractor is established or domiciled, confirming accordingly that:

(a) he has not breached his obligations relating to the payment of taxes, fees or social or health contributions,

(b) its liquidator or court has not been opened, its assets have not been declared bankrupt, its assets are not managed by the liquidator or court, has not entered into an agreement with creditors, its business activities are not suspended or in any other situation arising from a similar procedure provided for in rules of the place of initiation of this procedure.

9.6. The document referred to in point 9.5. (1) of the SWZ should be issued not earlier than 6 months before its submission. The documents referred to in point 9.5. (2) of the SWZ should be issued no earlier than 3 months before their submission.

9.7. Where in the country where the Contractor is established or domiciled, the documents referred to in point 9.5 shall not be issued. SWZ, or where those documents do not relate to all cases referred to in Article 108 (1) (1), (2) and (4) of the PZP, Article 109 (1) (1), (2) (a) and (b) and point 3 of the PZP, shall be replaced in whole or in part by a document containing the Contractor accordingly, indicating persons or persons entitled to its representation, or a declaration of the person to whom the document was to be concerned, taken under oath, or, if in the country where the Contractor is established or domiciled there are no provisions on a declaration under oath, lodged before a judicial authority or administrative, notary public, professional or economic self-government authority, competent by virtue of the seat or residence of the Contractor. The provisions of point 9.6 shall apply.

The Contracting Authority requires the provision of a security for the due performance of the contract by the contractor whose offer was considered the most advantageous in Package no 01/1, 02/1, 13/1, 13/1, 18/1 of the use of the forest — prior to the signing of the contract.

The security of the due performance of the contract shall be 1% of the total price per part of the order (the Package in question).

The security may be applied at the Contractor's choice in one or more of the following forms:

1) money;

2) bank surety or surety of the cooperative savings and credit unions, with the fact that the obligation of the cash register is always a monetary liability;

3) bank guarantees;

4) insurance guarantees;

5) the surety granted by the entities referred to in Article 6b (5) (2) of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development.

The security paid in the money the contractor will pay by transfer to the bank account of the Contracting Authority: BNP Paribas o/Przemyśl, account no 62 1600 1462 1016 7864 9000 0003, with a note on the blank of the transfer to which proceedings are concerned
