In the course of the present open procedure, the State Office for Central Police Services of North Rhine-Westphalia intends to conclude a framework agreement with an economic operator to support the police authorities of the State of North Rhine-Westphalia and the German Police University (DHPol).

With regard to the framework agreement, no minimum purchase quantities are agreed.

The scope of services results from the service description (chapter B section 1.2).

According to the case law of the ECJ of 17.06.2021 _ RS C - 23/20 - the contracting authority is obliged to specify a maximum quantity in order to ensure transparency and non-discrimination in competition.

A call-off obligation cannot be derived from this. The client estimates that there is a need for approx. 210,000 operating hours over the entire term of the contract.

The maximum quantity of the attached framework agreement is estimated at 231,000 operating hours.

The framework agreement ends without the need for termination, whichever occurs earlier, at the end of the term of the framework agreement (minimum term in the event of exercise of the right of termination by the client, or maximum term in the absence of termination by the client) or when it is reached

the maximum quantity.
