Gasunie Deutschland GmbH & Co. KG (“GUD”) is a transmission system operator within the meaning of the Energy Industry Act (EnWG) and operates a pipeline network of approximately 4,300 km in length in Germany.
In the context of current applications pursuant to §§ 33 and 39 of the GasNZV (see also Gas Network Development Plan 2020) and the energy transition in Germany, GUD will have a high demand for general contractor services in the event of the realization of the projects envisaged here. In this context, the projects planned for biogas feed-in must regularly be implemented within short periods of time. The preparation and planning of the projects already takes up a considerable part of the project duration. With regard to biogas feed-in projects, GUD pursues the strategy of outsourcing the necessary general contractor services and would like to define the legal framework for commissioning suitable contractors at an early stage by means of a framework agreement. After the conclusion of a framework agreement, a contractor is then commissioned after a so-called "mini-tender" (invitation to tender for the specific project) is carried out on the basis of project orders to be issued separately. Within the framework contract holders, the projects are awarded as part of a mini-tender process, in which the project-specific qualifications of the individual contract holders are checked.
Since the planning for the biogas project in Schwartenpohl has already progressed, there are two different lots for this award procedure:
Lot 1: BGEA Framework Agreement for General Contractor Services: Procurement procedure for the agreement of framework agreements for the basic provision of general contractor services in the course of projects for the construction of biogas feed-in plants including associated pipeline constructions (biogas supply, bad gas recirculation, oxygen and connection pipeline),
Lot 2: BGEA Schwartenpohl General contractor services: Provision of general contractor services in the biogas feed-in plant project in Schwartenpohl.

GUD points out that two lots will be put out to tender as part of this procedure:
Lot 1: BGEA Framework Agreement for General Contractor Services
Lot 2: BGEA Schwartenpohl general contractor services
Up to three (3) economic operators are being sought for Lot 1.
For Lot 2, a general contractor is being sought who can handle the concrete project for the construction of the biogas feed-in plant in Schwartenpohl.
After successful completion of the competition, applicants have the opportunity to bid for Lot 1 and/or Lot 2. It is possible to award contracts for Lot 1 and Lot 2. The allocation of the two lots is independent of each other. The basis is the lot-specific evaluation matrix.
