The subject of the contract is the provision of collection, transport and waste management services code 19 12 12 - other waste (including mixed substances and items), i.e. ballast from the oversize fraction> 80 mm, derived from the mechanical treatment of mixed municipal waste, produced at RZUOK in Machnaczu commune Brest Kujawski.
1) the subject of the contract is the provision of collection, transport and waste management services code 19 12 12 - other waste (including mixed substances and items), i.e. ballast from the oversize fraction> 80 mm, derived from the mechanical treatment of mixed municipal waste, generated in Regional Municipal Waste Utilization Plant in Machnacz, commune Brest Kujawski (hereinafter referred to as "RZUOK in Machnacz");
2) the estimated amount of waste anticipated for collection, transport and management, in a month is 1,000 Mg;
3) the total estimated amount of waste anticipated for collection, transport and management, during the contract period is 12,000 Mg;
4) the management of collected waste with the code 19 12 12 must take place in accordance with the requirements set out in the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2019 item 701), in the process of recovery and / or disposal , indicated by the contractor, in the offer form;
5) the contractor in the offer form is required to indicate the recovery or disposal process, in accordance with Annex No. 1 and / or Annex No. 2 of the Act of 14 December 2012 on waste (i.e. from 2019, item 701) to which they will be subjected waste collected from the contracting authority together with an indication of the name and address of the installation / plant to which the waste will be directed;
6) waste will be transferred in bulk. Loading of waste is on the side of the customer and will be done using an excavator with a bucket with a capacity of 1.1 m
7) each waste collection will take place by weighing the collected waste on the legalized balance of the contracting authority, located in RZUOK in Machnacz 41a, which will be confirmed by a weight receipt. This document will be the basis for determining the amount of waste collected by the contractor;
8) waste collection will take place successively on business days from Monday to Friday, between from 7.00 to 20.00, after prior written agreement of details of waste collection, including: date, time and type of vehicles, sent by e-mail or fax. The contractor will collect waste from the plant no later than within a maximum of 4 working days (response time - bid evaluation criterion) from sending the subject notification by the contracting authority;
9) the place of waste collection is: Regional Municipal Waste Utilization Plant in Machnacz 41a, commune Brest Kujawski (Kuyavian-Pomeranian Voivodeship);
10) the contracting authority reserves the right to reduce the amount of waste referred to in point 3 above, in such a situation the contractor is not entitled to claim:
- amounts due for unclaimed waste,
- compensation for lost profits;
11) the contracting authority, pursuant to art. 29 paragraph 3a of the PPL, requires that persons performing activities in the implementation of the subject of the contract, the performance of which consists of performing work in the manner specified in art. 22 § 1 * of the Act of 26 June 1974 - Labor Code, were employed by a contractor or subcontractor on the basis of an employment contract. The contractor or subcontractor will employ the abovementioned persons for the duration of the contract. In the event of termination of employment before the end of this period, he undertakes to immediately employ another person in his place.
