1. The subject of the contract is the execution of protective activities consisting in mowing, ringing and removal of trees and shrubs in the Natura 2000 Ostoja Napiwodzko-Ramucka PLH280052 site, in accordance with the description of the subject of the contract constituting Annex 1 to the SWZ.
2. The scope of the task covers habitats with a total area of approx. 36.23 ha:
Siedlisko 7110 - area 1.13 ha, wydz. 30i Leśnictwo Łowne Jezioro, nadl. Jedwabno;
Habitat 7230 - area 0.27 ha, ed. 222g, Leśnictwo Grobka, nadl. Jedwabno;
Siedlisko 7230 - area approx. 0.71 ha, wydz. 244A-g, Leśnictwo Grobka, nadl. Jedwabno;
Siedlisko 7140 - area approx. 34.12 ha, wydz. 139b (27.42 ha) and ed. nr 140a (6,70) ha Leśnictwo Trzęsawisko, Nadl. Jedwabno.
3. The implementation of the tasks results from the applicable plan of protection tasks for the above-mentioned Natura 2000 site.

3. The implementation of the tasks results from the applicable plan of protection tasks for the above-mentioned Natura 2000 site.
4. The order is carried out as part of the implementation of the project POIS.02.04.00-00-0108/16 "Protection of habitats and species of non-forest areas dependent on water" co-financed by the Operational Programme Infrastructure and Environment under Measure 2.4 Nature protection and environmental education under Priority Axis II Environmental protection, including adaptation to climate change.
5. Quality requirements relating to at least the main elements constituting the subject of the contract are included in the description of the subject of the contract constituting Annex 1 to the SWZ.
6. The contracting authority has not divided into parts the contract covered by these proceedings and does not allow partial bids. The activities covered by the tender procedure cover one Natura 2000 area and areas located in the area managed by one forest district. Moreover, dividing the task into lots would be economically unjustified in this case. Patches of habitat occupy small areas and occur not too far from each other. Division into parts and implementation of activities by, for example, two contractors will generate double costs, i.e. costs of employees, accommodation, travel to the place of work, fuel consumption. In view of the above, the division into parts has been abandoned.
7. A detailed description of the order is included in Annex 1 to the SWZ.

9. Requirements related to the performance of the contract in the scope of employment by the contractor or subcontractor on the basis of an employment relationship of persons performing activities indicated by the contracting authority in the field of contract performance, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labor Code (Journal of Laws of 2022, item 1510, as amended):
1) the type of activities related to the performance of the contract, which are subject to the requirements of employment on the basis of an employment relationship by the contractor or subcontractor of persons performing activities during the performance of the contract: work – chainsaw;
2) the method of verifying the employment of these persons and the right of the Ordering Party to control the Contractor's compliance with the requirements related to the employment of these persons and sanctions for non-compliance with these requirements, are specified in §7 of the Contract, which constitutes Annex 6 to the SWZ.
