1. The subject of this contract is the purchase of electricity for the facilities indicated in Annex 1 to THE SWZ, in accordance with the provisions of the Act of 10 April 1997. Energy Law, civil code and implementing regulations issued on their basis. The Kwidzyn County and the units listed in Annex 1 will conclude separate contracts resulting from this public procurement procedure under the unlimited tender procedure for the PURCHASE OF ELECTRICITY FOR THE NEEDS OF THE KWIDZYN COUNTY - DISTRICT OFFICE IN KWIDZYN AND ITS ORGANIZATIONAL UNITS Detailed information on the conclusion of contracts by the District and its organizational units is included in Annex No. 1 to the SWZ. It will be the duty of the selected Contractor to represent the Ordering Party and its organizational units before the appropriate Distribution System Operator (if applicable) in matters related to the notification of a change of seller. To perform the above-mentioned activities, the Contractor will receive an appropriate power of attorney (Annex No. 4.1 to SWZ) 2. Order – purchase of electricity for facilities listed in Annex 1 to SWZ: 1) The estimated demand for electricity in the period from 01.01.2023 to 31.12.2023 is 604 429.00 kWh. 2) The estimated value of the contract in the period from 01.01.2023 to 31.12.2023 is PLN 1,208,858.00 3) Performance of activities resulting from the power of attorney, constituting Annex No. 1 to the Proposed provisions of the contract (Annex No. 4.1 to SWZ), in particular the Ordering Party obliges the Contractor to notify the indicated Distribution System Operator to perform the electricity sales contract concluded with the Contractor, make declarations of will and determine on behalf of the Ordering Party all necessary information in the scope of terminating the existing contract for the sale of electricity and the provision of distribution services (comprehensive agreement), representing the Ordering Party before the relevant Distribution System Operator in matters related to the conclusion of the contract for the provision of distribution services.
