IT services contract relating to the XRP Ultimate Cegid ERP, ("the Application"), and having as its object the performance of services: - either corrective TMAs not incorporated by the publisher in its maintenance contract ("Tma-1"), - or aimed at improving / developing the application ("Evolutions"): * on the one hand, through "small" evolutions, * on the other hand, significantly through "Projects". - Either "punctual"; functional and technical services likely to strengthen the autonomy of the contracting authority's internal teams ("one-off services"). The contract also includes the reversibility of services, aimed at guaranteeing continuity of service, by ensuring the transmission of knowledge to a buyer and/or to the contracting authority's internal teams. This contract consists of a framework agreement within the meaning of the provisions of Articles R2162-1 to 14 of the French Public Procurement Code (CCP) and an ordinary service contract. The framework agreement covers the performance of: * works related to the acquisition of the technical context of the contractor's intervention,* services intended to carry out changes in application,* so-called "one-off" services,* services induced by the reversibility phase. The framework agreement is a single-contractor and is executed at the same time:- by the issuance of purchase orders, under the conditions set out in Articles R. 2162-13 and R. 2162-14 of the SPC, with regard to the execution of the :* phases of becoming aware of the technical context of the contractor's intervention,* reversibility.- by the conclusion of contracts subsequent to purchase orders, under the conditions set out in Articles R. 2162-7 to R. 2162-12 of the CCP, with regard to the performance of :* services aimed at carrying out "one-off" and "one-off" developments. The services provided by Tma-1 are carried out within the framework of the ordinary service contract. The contract consists of a single tranche. It comprises a single lot, in accordance with Art L2113-11 of the CCP, the devolution into separate lots being in this case, likely to make the performance of the services technically difficult or financially more expensive.this new procedure is initiated following a declaration of unfruitfulness (OJEU opinion 2023/s 150-478755)
