Since the amendment of the collective agreement and the amendment of the Bavarian Salary Act, company bike leasing in the public sector has been possible for employees and civil servants. The aim for the district office is to conclude a framework agreement with a service provider for the processing of company bike leasing. This makes it possible to conclude leasing contracts for bicycles, which the client makes available to his employees for business and private use in a tax-privileged or tax-free manner.
The district of Augsburg, as the client, concludes a framework agreement with the contractor. This makes it possible to conclude leasing contracts for bicycles, which the client makes available to his employees for business and private use in a tax-privileged or tax-free manner.
The client and the contractor conclude a framework agreement for the services to be provided for 48 months. This includes the creation and management of the service processes from order to termination as well as repatriation and claims settlement according to the specifications of the service description and the service specification. The framework agreement is provided by the Contractor and meets the requirements of the bill of quantities. In addition, the AG and the Contractor conclude a leasing framework agreement in which the framework conditions for all future individual leasing contracts are defined.
The Client shall conclude an individual leasing contract with the Contractor for each bicycle ordered by an employee. At the same time, the client concludes a leasing agreement with the respective employees for these bicycles, in which mutual rights and obligations with regard to the bicycle and salary conversion are regulated.
The framework agreement does not specify a minimum purchase quantity of bicycles or individual leasing contracts. An estimated purchase of approx. 75 bicycles is expected over the entire framework contract period. The maximum purchase was set at a maximum of 300 bicycles within the term of the framework agreement.
