Description:
Purchase of electricity for the Olsztyn City Hall Group represented by the Olsztyn Municipality for 2023.

1. The subject of the contract is the supply of electricity in 2023 for the UM Olsztyn Group represented by the Municipality of Olsztyn for the purposes of operating buildings and commercial premises as well as powering technological equipment, street lighting and signaling.

2. The sale of electricity will take place to the Ordering Party's facilities in the scope of consumption points listed in the annexes to the SWZ, under the conditions specified in the provisions of the Act of 10.04.1997. Energy Law and the Act of 23.04.1964. Civil Code and implementing regulations issued on their basis.

3. The order is divided into 2 (two) parts, according to the type of electricity collection.

4. Detailed data on electricity consumption points: name, address, PPE number, local DSO, tariff group, contractual capacity, reduced (seasonal) contractual capacity, forecasted volume of energy during the term of the contract, information on the date of commencement of sale and type of demand are presented in the annexes to the SWZ

Part I – Power supply for street lighting and traffic lights.

1. The subject of the contract covered by Part I is the supply of street lighting and traffic lights, in accordance with the estimated amount of energy supplied during the delivery period specified in the SWZ,

2. The Ordering Party provides that the actual amount of electricity consumption may change, i.e. increase or decrease while maintaining the offered unit prices given in the Contractor's offer. Thus, the indicated estimated electricity consumption does not constitute an obligation for the Ordering Party to purchase electricity in the given quantity.

3. Throughout the duration of the contract, the Contractor shall be obliged to have a current general contract for the provision of electricity distribution services with a local distribution system operator operating in the area of occurrence of electricity consumption points listed in the annexes to the SWZ.

4. Detailed data on electricity consumption points: name, address, PPE number, local DSO, tariff group, contractual capacity, reduced (seasonal) contractual capacity, forecasted volume of energy during the term of the contract, information on the date of commencement of sale, name of the current energy seller and type of demand are presented in the annexes to the SWZ.

5. The contracting authority does not provide for the award of contracts referred to in Article 214(1)(a). 8 of the PPL Act.

6. The Contracting Authority (Olsztyn Municipality) pursuant to Article 38(1) of the Act of 29 January 2004. The Public Procurement Law has been authorized to conduct this procedure and award the contract in the name and on behalf of the other Contracting Authorities specified in detail in Annexes 7a to the SWZ, who under the name "UM Olsztyn Group" decided to jointly conduct the procedure and award a contract for the purchase of electricity in 2023, in accordance with the concluded agreements. The list of recipients covered by the order together with the data of invoice buyers is attached to the SWZ. Due to the limitations in this form of the contract notice sent for publication in the Supplement to the Official Journal of the European Union as regards the number of items provided for individual Contracting Authorities who jointly conduct the procedure and award the contract, only Contracting Authorities with legal personality listed in Annex 7 to the SWZ, to which the other entities listed in Annex No. 7a to SWZ.

7. A detailed description of the subject of the contract covered by Part I of the contract is specified in the SWZ.

Part II – Power supply for other facilities, including buildings and installations.

1. The subject of the contract covered by Part II is the supply of other facilities, including buildings and installations, in accordance with the estimated amount of energy supplied during the delivery period specified in the SWZ,

2. The Ordering Party provides that the actual amount of electricity consumption may change, i.e. increase or decrease while maintaining the offered unit prices given in the Contractor's offer. Thus, the indicated estimated electricity consumption does not constitute an obligation for the Ordering Party to purchase electricity in the given quantity.

6. A detailed description of the subject of the contract covered by Part II of the contract is specified in the SWZ.

7. The contracting authority does not provide for the award of contracts referred to in Article 214(1)(a). 8 of the PPL Act.

8. The Contracting Authority will apply the procedure referred to in Article 139(1) of the PPL Act (the so-called reverse procedure), i.e. in the first place the Contracting Authority will examine and evaluate the tenders, and then make the subjective qualification of the Contractor whose offer will be the highest evaluated in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procurement procedure.
