The subject of the contract is the design and implementation of extensive repair and renovation activities related to, m.in, the replacement of insulation on the flat roof of the underground parts of the building of the Silesian Museum in Katowice at 1 T. Dobrowolskiego Street in Katowice and on the walls to a depth of approx. 3 m from the flat roof level.
1. The subject of the contract is the design and implementation of extensive repair and renovation activities related to, m.in, replacement of insulation on the flat roof of the underground parts of the building and on the walls to a depth of approx. 3 m from the flat roof level. The subject of the contract includes the repair of critical places and elements of the main building of the Silesian Museum in Katowice and its protection against excessive inflow and penetration of water into the structure and into the interior of the building. It is also planned to introduce new or improve existing elements of land development in order to increase its attractiveness and improve the quality and comfort of use.

2. The Contractor shall provide the Contracting Authority with a quality guarantee for the subject of the contract (including in particular works, materials used, equipment, installations, Design Documentation) and a warranty for defects for a period of at least 60 months. The guarantee and warranty for the performed subject of the contract is a criterion for the evaluation of offers, a detailed description of which can be found in Chapter XIV, section 2, point 2) of the Terms of Reference.
3. The subject of the contract was estimated on the basis of the planned costs of construction works – indicative investment costs, basic contract PLN 35,093,783.02 (net), similar order PLN 3,216,870.00 (net).
The Contracting Authority informs that it intends to allocate the gross amount of PLN 43,165,353.11 to finance this basic contract (excluding similar orders).
4. The Contractor is obliged to complete the subject of the contract within 24 months from the date of conclusion of the contract. The deadline for the execution of the order is considered to have been met provided that all tests and checks, as well as works and works, are completed within this period, the construction site is cleaned up and the works are reported as ready for Final Acceptance, provided that this acceptance is positively made.
5. The Contracting Authority does not require the submission of the evidence in question together with the offer.
6. A detailed description of the subject matter of the contract (hereinafter referred to as the "OPZ") is contained in the "Functional and Utility Program" – Appendix No. 1 to the Terms of Reference with Appendices
In addition, the Contractor is obliged to perform the subject matter of the contract in accordance with the Material Provisions of the Contract - Appendix No. 2 to the Terms of Reference.
7. The Contracting Authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law (hereinafter referred to as "similar contracts"), consisting in the repetition of similar construction works.

The Ordering Party reserves the right to change the quantity (measurement) of a given type of work. Similar orders will be carried out in the same location as the main subject of the contract, i.e. 1 T. Dobrowolskiego Street, Katowice. The value of the anticipated similar orders will not exceed the net amount of PLN 3,216,870.00.
(2) Conditions under which similar contracts will be awarded:
a) on the terms and conditions set out in the Material Provisions of the Agreement (Appendix 2 to the Terms of Reference), including those concerning the terms of payment,
b) provided that the Contracting Authority has the necessary financial resources and the Contractor accepts the Material Terms and Conditions of the existing contract, and the Parties, as a result of negotiations, agree on the amount of remuneration and the deadline for the performance of such contract.
