The subject matter of this order shall be:

Modernization of the municipal stadium in Ząbkowice Śląskie, in accordance with

with design documentation and building permit decision No. 142/2022 of 30/05/2022 in the scope of plots with registration numbers 3, 4, 5, 7/2, 8, 9/4, 9/5, 9/6, AM-6, Precinct Osiedle Wschód, Janusza Kusocińskiego m. Ząbkowice Śląskie and by decision of the building permit No. 176/2022 of 13/07/2022 regarding the plot with the registration number 3, AM – 6, Precinct Osiedle Wschód, Janusz Kusocińskiego Street, Ząbkowice Śląskie Town.

Location of the investment:

The investment in question is located in Ząbkowice Śląskie, Janusz Kusocińskiego Street, m. Gmina Ząbkowice Śląskie is bordered by the gminas of Ząbkowice Śląskie, Ząbkowice Śląskie County, Lower Silesian Voivodeship, plots with registration numbers 3, 4, 5, 7/2, 8, 9/4, 9/5, 9/6, AM-6, Osiedle Wschód.

1. Possible indication in procurement documents describing the subject of the contract of proper names, trademarks, patents or origin, source or specific process that characterizes products or services - is not intended to infringe Article 16 of the Pzp. and Article 99 (4) of the Pzp, but in in particular, the implementation of Article 17 (1) points 1 and 2 of the Pzp The descriptions included in the SWZ are designed to specify the qualitative, technological, performance or functional expectations of the Ordering Party. In accordance with Article 99 (5) and (6) and Article 101 (4) of the Pzp. The Ordering Party indicates,

that the contractor may offer the subject of the contract with a specific description contained in the order documents or equivalent.

2. Requirements for employment on the basis of an employment relationship, in the circumstances referred to in Article 95 of the PPL:

1) the type of activities related to the performance of the contract to which the requirements of employment on the basis of an employment relationship by the contractor or subcontractor of persons performing activities during the performance of the contract apply:

a) Pursuant to Article 95(1) of the PPL, the Contracting Authority indicates that for activities consisting of: preparatory, earth, demolition, paving, reinforcement, concrete, masonry, carpentry, roofing, carpentry, assembly, locksmithing, plastering, painting, finishing, flooring, insulation, installation, electrical, sanitary – works performed by the so-called physical workers specifies the requirement to employ persons performing these activities on employment contract in accordance with Article 22 § 1 of the Act of 26 June 1974 – Labour Code.

3. The Contracting Authority does not provide for the requirements referred to in Article 96 (2) of u.p.z.p.

4. The Contracting Authority shall not reserve the obligation of the contractor to perform the contract in person key parts of the contract.

6. Communication in the procurement proceedings, including the submission of tenders, exchange of information and the transfer of documents or statements between the contracting authority and the contractor, taking into account the exceptions set out in the Act shall be carried out by means of electronic communication.

7. All statements, documents, including the OFFER shall be prepared by the Contractor in accordance with the Regulation of the Prime Minister of 30 December 2020 on the method of preparing and submitting information and technical requirements for electronic documents and means of electronic communication in the public procurement procedure or competition (Journal of Laws of 2020, item 2452), under pain of nullity, in form or in electronic form and bearing:

a qualified electronic signature (issued by a qualified trust service provider, which is an entity providing certification services, meeting the security requirements set out in the Act of 5 September 2016 on trust services and electronic identification /Journal of Laws of 2020, item 1173, as amended/);

OR a trusted signature (referred to in Article 20 aa of the Act of 17 February 2005 on computerization of the activities of entities performing public tasks (Journal of Laws of 2020, item 346, i.e.);

OR a personal signature (referred to in Article 10a paragraph 3 of the Act of 6 August 2010 on identity cards (Journal of Laws of 2021, item 816, as amended).

The means of electronic communication used to submit a statement/s, document(s), OFFER by the Contractor is its correct submission in the TAB OF THESE PROCEEDINGS, on the Platform available at:

8. The contracting authority may cancel the procurement procedure if the public funds that the contracting authority intended to allocate to finance all or part of the contract have not been awarded to it.
