1. The subject of the contract covered by this procedure is a comprehensive supply of electricity and distribution to the facilities of the Contracting Authority and organizational units in the period not earlier than from 01.06.2023 to 31.12.2023. A detailed description of the subject of the contract contains the Description of the Subject of the Contract, constituting an attachment to the SWZ. 2. The Biała Rawska Commune is entitled to conduct a tender procedure on behalf of all organizational units. The purchased electricity will be consumed for the needs of the final buyer (customer) within the meaning of the provisions of the Act of 16 December 2008 on excise duty. 3. The existing agreements separated for sale expired on 31.12.2022 and the Ordering Party is bound by reserve sales agreements. The obligation of the selected Contractor will be to terminate the existing contracts for the sale of electricity and provision of distribution services (comprehensive agreements) and to represent the Contracting Authority and its organizational units before the relevant Distribution System Operator in matters related to the conclusion of new comprehensive agreements. To perform the above-mentioned activities, the Contractor will receive an appropriate power of attorney. 4. The Ordering Party declares that:  the procedure of selecting the Energy Seller in the form of a tender takes place once again,  had signed contracts with: Energa – Obrót S. A., Al. Grunwaldzka 472, 80-309 Gdańsk, Veolia Energy Contracting Poland Sp. z o. o., Puławska 2, 02-566 Warsaw ENEA S. A., Górecka 1, 60-201 Poznań for the sale of energy for a definite period until 31.12.2022 on PPE, in accordance with the annex to the SWZ,  has signed a distribution agreement for an indefinite period with a local DSO, PGE Dystrybucja S.A.,  provides the Seller selected through a tender procedure with PPE data in the form of an MS Excel file,  has not concluded other loyalty agreements. 5. The estimated demand for electricity for the Ordering Party's facilities in the period from 01.06.2023 to 31.12.2023 is 947 770 kWh (Appendix No. 6 to SWZ). Estimated quantities of energy demand are quantities used only to select the most advantageous offer of the Contractor. The actual value will depend on the amount consumed at each energy point. 6. The actual amount of electricity consumed by the Ordering Party shall be determined and settled on the basis of indications of metering and settlement systems of facilities. 7. The Contractor shall not be entitled to any claim for failure to collect the estimated amount of electricity by the Ordering Party. 8. The Contracting Authority has not divided the contract into lots – thus the Contracting Authority does not allow partial bids referred to in Article 7(15) of the PPL 10. Justification for not making the division: The Contracting Authority did not divide the contract into lots due to the specificity of the subject of the contract and the fact that the implementation of its individual parts by different Contractors would not be rational from the point of view of the financial interest of the Contracting Authority, because it could result in excessive costs of performing the contract.
