The subject of the contract is the supply of diesel oil for the Ordering Party's own needs to its headquarters in the amount of approximately 200 m3 in the period from 1 January 2024 to 31 December 2024, i.e. approximately 200 m3 per year, meeting at least the quality parameters in accordance with the PN-EN-590 standard, appropriate for a given season. Thus, the contracting authority does not guarantee the contractor that it will order oil in the amount of 200 m3. The contracting authority sets the minimum amount of oil to be purchased from the contractor at 160 m3 during the entire term of the contract. Diesel oil should comply with the Polish standard: PN - EN 590: 2013 -12E "Fuels for motor vehicles - Diesel fuels - requirements and test methods" and the Regulation of the Minister of Economy of 22 April 2020 amending the quality requirements for liquid fuels (i.e. Journal of Laws of 2023, item 1314), with the provisions of the Regulation being mandatory.

3. The offered and delivered diesel fuel must comply with the currently applicable law as at the date of submission of bids. In the event of a change in regulations or their replacement by other regulations, the supplied diesel fuel must always meet the requirements resulting from the regulations in force on the date of delivery.
4.The diesel fuel offered and supplied must be microbiologically clean and must be resistant throughout the year to possible microbiological contamination in the tanks and installations of service stations and in buses.
5.The additives of the diesel fuel offered and supplied shall be compatible with all commercially available authorised engine oils.
6. Diesel oil is intended to power diesel engines in city buses meeting Euro IV to Euro VI emission standards, operating in difficult conditions of public transport.
7. The Contracting Authority allows for the execution of the contract with the use of subcontractors. The contracting authority does not specify which part of the contract cannot be entrusted to subcontractors. The Contracting Authority on the basis of Article 462(2) requires the contractor to indicate in the tender the part of the contract which it intends to entrust to subcontractors and to the contractor to specify the companies of the subcontractors.
8. The Contracting Authority requires the contractor to provide the names and contact details of the subcontractors and their contact persons involved in the performance of the contract before commencing the performance of the contract. The Contractor notifies the Contracting Authority of any changes in the data during the performance of the contract, as well as provides information on new subcontractors to whom it intends to entrust the performance of the contract at a later date.
9.If the change or resignation from a subcontractor concerns an entity whose resources the contractor relied on, in accordance with the rules set out in Article 125(5), in order to demonstrate compliance with the conditions for participation in the procedure, the contractor shall be obliged to demonstrate to the contracting authority that the proposed other subcontractor or contractor independently fulfils them to a degree no less than the subcontractor whose resources the contractor relied on during the procurement procedure.
10. Delivery of diesel oil will take place for each order of the Ordering Party at least 3 times a month, in the amount of about 5 m3 at a time within 3 days of placing the order between 7:00 a.m. and 2:00 p.m. on working days.
11. The Contractor shall perform min. 2 times a year, at its own expense, calibration of the device owned by the Ordering Party (i.e. non-pressurized above-ground tank for storing diesel oil BT/FM 5000).
12. By 31 August 2021, the Contractor shall clean the BT/FM 5000 non-pressurised above-ground tank for storing diesel oil located on the premises of MZK at its own expense.
