1.The subject of the contract is the development of design documentation along with obtaining decisions permitting the implementation of construction works for the task entitled Construction of a viaduct over the track system along Kąpielowa Street.
132 of the Public Procurement Law Act of 11 September 2019 (i.e. Journal of Laws of 2022, item 1710, as amended - hereinafter referred to as the PPL Act).
3. The value of the order exceeds the PLN equivalent of EUR 215,000.
1.The subject of the contract is the development of design documentation along with obtaining decisions permitting the implementation of construction works for the task entitled Construction of a viaduct over the track system along Kąpielowa Street.
2.The subject of the contract has been divided into four stages:
2.1. Stage I (basic order) – development of construction projects along with the preparation and submission of applications for issuing decisions permitting the implementation of construction works and obtaining the initiation of proceedings for issuing decisions permitting the implementation of construction works,
2.2. Stage II (basic order) – obtaining final or immediately enforceable decisions of ZRID and/or PnB and developing detailed designs, bills of quantities, investor cost estimates, STWIORB and other documents required for the implementation of the investment,
2.3. Stage III (contract covered by the option right) – answering the questions of bidders in the procedure for the award of a public contract for construction works,
2.4. Stage IV (covered by the option right) – exercising author's supervision in all industries covered by the documentation during the execution of works on the basis of the developed documentation.
3.A detailed description of the subject of the contract and the scope of the Contractor's obligations are specified in the annexes to the Terms of Contract (hereinafter referred to as the SWZ), including m.in in the Draft Contractual Provisions (hereinafter referred to as the PPU), constituting Annex 1 to the SWZ and in Annex 1 to the PPU – Description of the subject of the contract.
4. On-site inspection - the Contracting Authority does not provide for a site visit.
5.The contracting authority, pursuant to Article 139(1) of the PPL, provides for a reverse sequence of actions, i.e. it will first examine and evaluate the bids, and then it will make a subjective qualification of the Contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. In connection with the application of the above procedure, the Contracting Authority does not require a statement in the form of a European Single Procurement Document (ESPD) to be submitted together with the tender. The Contracting Authority requests this statement only from the Contractor whose bid was rated the highest.
6.The contracting authority provides for the award of contracts referred to in Article 214(1)(7) of the PPL, consistent with its subject matter constituting a repetition of a similar subject of the contract up to the gross amount of PLN 430,500.00. The Contracting Authority provides for the possible conclusion of contracts for similar services (design services) within 3 years from the date of award of the basic contract, and the Contractor's remuneration will be determined after prior negotiations with the Contractor.
7.The Contracting Authority does not require that persons participating in the performance of the contract be employed by the Contractor or Subcontractor on the basis of an employment contract within the meaning of the provisions of the Act of 26 June 1974 - Labor Code.
8. The Ordering Party does not require the Contractors to submit the means of proof in question.
9. The Ordering Party does not require a deposit.
10.Before concluding the contract, the Contractor whose offer was considered the most advantageous is obliged to lodge a performance bond in the amount of 5% of the price specified in the offer for the basic order (Stages I and II).
11.The information obligation resulting from Regulation (EU) 2016/679 of the EP and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – is described in Section XXII of the SWZ.
12.The Contracting Authority mentions that due to the technical inability to indicate in the content of this announcement all information, including the subject of the contract (too few characters that can be entered in individual fields of the form), this announcement contains references to the content of the SWZ posted on the website of the proceedings, where there is a complete set of information.
