Detailed description of the subject of the contract

§1

• The Contractor undertakes to perform the subject of the contract regarding the management of mixed municipal waste from the area of the Municipality of Zławieś Wielka under the conditions specified in the SWIZ, the model contract and the contractor's offer, constituting Annex 1 to the SWIZ.

The Ordering Party stipulates that during the term of the contract, other types of waste than those listed in Table 1, the quantities of which are presented in Table 2, may optionally be delivered.

• The types and quantities of waste given in Table 1 are estimates. The Ordering Party reserves that the actual amounts of waste will result from the current needs of the Ordering Party and may differ from the quantities given in Table 1. Settlements between the Ordering Party and the Contractor will be carried out on the basis of unit prices offered by the Contractor in the Offer Form.

• The quantities given are estimates. An order to collect a quantity less than the indicated quantity may not become the basis for claims against the Ordering Party

• The Contractor will be obliged to manage waste in the Municipal Installation.

§ 2

Obligations of the Contractor:

• The Contractor is obliged to comply with the law during the implementation of the subject of the contract, in particular such as:

• the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2021, item 888),

• the Act of 27 April 2001. Environmental Protection Law (Journal of Laws of 2022, item 1260, as amended),

• the Act of 14 December 2012 on waste (Journal of Laws of 2021, item 779, as amended),

• Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for collecting municipal waste from property owners (Journal of Laws of 2019, item 122),

• Regulation of the Minister of the Environment of 15 May 2012 on the templates of reports on municipal waste collected, liquid waste collected and the implementation of tasks in the field of municipal waste management (Journal of Laws of 2018, item 1627),

• the Act of 11 September 2015 on waste electrical and electronic equipment (Journal of Laws of 2020, item 1893),

• the Act of 24 April 2009 on batteries and accumulators (Journal of Laws of 2022, item 1113),

• Regulation of the Minister of the Environment of 16 June 2009 on occupational health and safety in municipal waste management (Journal of Laws of 2009 No. 104, item 868),
