"Comprehensive supply of high-methane natural gas (group E) to the Jarosław Purchasing Group for the period from 01.09.2022 to 31.12.2023"

1. The subject of the contract is a comprehensive supply of high-methane natural gas (group E), i.e. the supply of gaseous fuel together with a distribution service to the Ordering Party's facilities, in the period from 01.09.2022 to 31.12.2023, divided into two parts of the contract:

1.1. part I concerns gas collection points (also called PPG), which will be settled according to the tariff price approved by the President of the Energy Regulatory Office within the meaning of the Act of 26 January 2022 on special solutions for the protection of gaseous fuel customers in connection with the situation on the gas market and competitive market prices (mixed settlement), with a maximum fuel demand of 18 775 029 kWh – according to Annex 1A to SWZ.

1.2. Part II concerns PPGs which are numerous according to competitive market prices, with a maximum fuel demand of 4 053 204 kWh – according to Annex 1B to the SWZ.

1. The subject of the contract is a comprehensive supply of high-methane natural gas (group E), i.e. the supply of gas fuel together with the distribution service to the Ordering Party's facilities, in the period from 01.09.2022 to 31.12.2023, part I applies to gas consumption points (also called PPG), which will be settled according to the tariff price approved by the President of the Energy Regulatory Office within the meaning of the Act of 26 January 2022 on special solutions for the protection of gas fuel customers in connection with the market situation on the market. gas and competitive market prices (mixed settlement), with a maximum fuel demand of 18 775 029 kWh – according to Annex 1A to swz. In the event that the Ordering Party is an entity entitled to settlements according to tariff prices approved by the President of the Energy Regulatory Office within the meaning of the Act of 26 January 2022 on special solutions for the protection of gaseous fuel customers in connection with the situation on the gas market, it signs the STATEMENT of the RECIPIENT OF GASEOUS FUELS on the purpose of gaseous fuel, according to the template constituting an annex to the Regulation of the Minister of Climate and Environment of 28 January 2022. A given PPG may be partially or fully settled according to the prices from the Sales Tariff (tariff price) approved by the President of the Energy Regulatory Office – the information is included in Annex 1A to the SWZ – description of the subject of the contract. This Statement is annexed to the present proceedings. The Ordering Party reserves the right to change the scope of the Statement during the term of the order, i.e. the loss of the right to settle according to tariff prices and the acquisition of the right to settle according to tariff prices. In such a case, the Ordering Party shall submit an appropriate statement consistent with the facts,

2. Gaseous fuel should be delivered around the clock to the delivery and demand points listed in Annex 1A to the SWZ, which is a set of gas equipment used to connect the internal network, owned by the Ordering Party with the gas network of the system operator.

3. The Contractor shall be obliged to ensure the quality standards of the Ordering Party's service in accordance with the energy laws in force in this area. It is necessary to ensure continuity of supply without any interruptions, except as described in the Energy Law Act, IRIESD, tariff and have a provision that guarantees continuity of supply.

4. Ownership of gas fuel passes to the Ordering Party after measurement is taken at the exit of the gas meter.

5. The demand for gaseous fuel has been assumed on the basis of the historical consumption of gaseous fuel and may differ from the actual use of gaseous fuel, because it is not possible to determine in advance the amount of gaseous fuel that will be delivered to the Ordering Party. The quantity of the order does not constitute an obligation on the part of the Ordering Party to purchase gaseous fuel in the specified quantity and in no case may it be the basis for any claims on the part of the Contractor.

6. Settlements for the sale and distribution of gaseous fuel will be carried out on the basis of current indications of the measurement and settlement system (data provided by the distribution system operator hereinafter referred to as "osd"), in accordance with the settlement periods resulting from the current dso tariff, while for tariffs with the number of readings in years 1 and 2 it is possible to settle on the basis of estimated (forecasted) consumption.

7. PPG addresses, tariff groups, contract data, consumption and other necessary information are included in Appendix 1A to the SWZ.

8. The Contractor undertakes to carry out the procedure of changing the seller of gaseous fuels, in accordance with the Instructions for the Operation and Operation of the Distribution Network (IRiESD) regarding the provision and use of gas fuel distribution services - data on contracts are included in Annex 1A to the SWZ.

9. Information about the currently applicable contracts is described in Annex 1A to the SWZ in the column "Duration of the current contract / notice period".
