Description:

1. The subject of the contract is the provision of a service for collecting and managing solid municipal waste: unsorted and segregated for 2019,

With the division into two independent tasks:

• Task I:

Collection and management of solid, unsorted, municipal waste and sorted waste: glass - waste code 20 01 02, paper and cardboard - waste code 20 01 01, metals and plastics - waste code 20 01 40, 20 01 39, from administered complexes through the 41st School Aviation Base in Dęblin - complexes:

• Dęblin Airport commune Dęblin, 08-521 Dęblin, ul. Pride Team 5 along with street bins in the amount of 50 pcs, which are the property of the Employer

• Dęblin Fortress, commune Dęblin, 08-521 Dęblin, ul. Saperów 5 with 40 street bins, which are the property of the Employer

• Stawy commune Dęblin, 08-530 Dęblin, ul. Stawska with 20 street bins, which are the property of the Employer

• Niebrzegów commune Puławy, 24-100 Puławy, Niebrzegów town

• Klikawa commune Puławy, 24-100 Puławy, town of Klikawa

• WKU Puławy commune Puławy, 24-100 Puławy, ul. Piłsudskiego 93

• Stężyca commune Stężyca, 08-540 Stężyca, ul. Dęblińska 149 with 8 street bins, which are the property of the Employer

And unsorted waste (street bins) from the complexes:

Airport, fortress, ponds and Stężyca.

• Task II:

Collection and management of solid unsorted municipal waste (mixed) - waste code 20 03 01 and municipal waste sorted glass - waste code 20 01 02, paper and cardboard - waste code 20 01 01 and metals and plastics - waste code 20 01 40 , 20 01 39

From the following military complexes administered by the 41st School Aviation Base in Dęblin - complexes:

• Roskosz, commune Biała Podlaska, 21-500 Biała Podlaska

• Sidorki, commune Biała Podlaska, 21-500 Biała Podlaska

• WKU Biała Podlaska, ul. Al. 1000-lecia 28, commune Biała Podlaska, 21-500 Biała Podlaska

The service includes securing adapted containers by the Contractor

To implement the above-mentioned service.

2. The contracting authority allows the submission of partial bids, which means that the contractor may submit a bid for the full scope of one or two tasks (parts) of the contract. Each complete task is part of the order. The awarding entity allows the submission of an offer for all or selected tasks (part) of the contract. Each task (part) of the contract will be assessed separately. Offers not containing the full scope of the subject of the contract specified in individual tasks will be rejected on the basis of art. 89 paragraph 1 point 2) of the Public Procurement Law.

3. The Employer does not require the Contractor to perform key parts of the contract personally.

4. Description of the object of the contract is below and in:

• Annex No. 1 to the ToR, ie the offer form;

• Annex No. 1a to the ToR, ie a detailed description of the subject of the contract for task I and task II;

• Annex No. 1b and 1c to the ToR, ie a list of parking places for containers for municipal waste, unsorted and segregated, along with the planned timetable for their collection separately for task I and task II;

• Annex 6a and 6b to the ToR, ie the general terms and conditions of the contract for

Tasks I and tasks II.

5. Attention! The Employer enables the Contractors to make a local vision of the places where containers for municipal waste are to be set up - within the complex of 41 BLSz, in order to prepare an offer.

The time limits for the local vision of areas and facilities, depending on individual complexes, are as follows:

- Task I: October 5, 2018 at 9:00 (complexes: Dęblin-Lotnisko, Dęblin-Twierdza, Głusiec, WKU Puławy, Klikawa) and 6/10/2018 at 09.00 (complexes: Stawy, Stężyca, Jagodne),

- Task II: 5/10/2018 at 09.00 (complexes: Roskosz, Sidorki, WKU Biała Podlaska).

Task I:

Performers interested in participating in the local vision should appear on the day

October 5, 2018 at 9:00, in the military complex Dęblin - Airport (pass office). After the local visit at the Dęblin - Airport military complex, interested contractors will go to the Dęblin-Twierdza military complex. After completing the local vision in the Dęblin-Twierdza military complex, interested contractors will go to the Głusiec military complex. After completing the local vision in the Głusiec military complex, interested contractors will go to the Military Supplementary Command in Puławy. After completing the local vision at the Military Headquarters in Puławy, interested contractors will go to the Klikawa military complex.

Contractors interested in participating in the local vision should appear on 6.10.2018 at 9:00, in the Stawy military complex (passes office). After completing the local vision in the Stawy military complex, interested contractors will go to the Stężyca military complex. After completing the local vision at the Stężyca military complex, interested contractors will go to the Jagodne military complex.

Task II

Those interested in participating in the local vision of the contractor in the military complex Roskosz - barracks near Biała Podlaska should appear on October 5, 2018 at 9:00 (place of appearance - pass office in the Roskosz - barracks near Biała Podlaska). After completing the local vision in the Roskosz - barracks military complex near Biała Podlaska, interested contractors will go to the other complexes according to the instructions of the person responsible for the local vision.

The vision will include, depending on the interest of contractors - all facilities that are the subject of the services rendered for three tasks.

Conducting any arrangements with the person who will show the subject of the contract is not binding - all substantive inquiries should be directed in writing directly to the address of the Employer. A report will be prepared on the site visit.

The Employer does not provide explanations during the site visit. It is forbidden to take photos, recordings and data collection during the site visit

6. Equivalent solutions:

If the description of the subject of the contract and the general conditions of the contract appear: names of manufacturers, trademarks, patents or origin, source or specific process that characterizes products or services provided by a particular contractor and references to standards, European technical assessments, technical specifications and reference systems technical and references to performance or functionality requirements regarding selected features -

The Employer recommends that such indications be treated as exemplary, i.e. that they specify the minimum technical, operational and operational parameters required by the Employer (they are exemplary), it allows the contractor to apply equivalent solutions provided that they have at least the same or better parameters technical and functional and will not lower the standards specified in the documentation and ensure the performance of the contract in accordance with the Employer's requirements set out in the ToR.

The contractor who refers to equivalent solutions is required to demonstrate that the materials or equivalent products offered by him to perform the subject of the contract and other equivalent elements meet the requirements specified by the contracting authority (the basis of Article 30 (5) of the Act) by submitting together with the offer a list of all proposed materials and other equivalent elements and demonstration of their equivalence with respect to the materials and other elements described in the ToR.

The submitted description of the proposed equivalent solutions must be detailed enough for the contracting authority to assess the fulfillment of the requirements regarding their technical parameters and decisions as to whether the proposed solutions are equivalent. This means that the contractor is required to demonstrate that the materials and other elements offered by him are equivalent to those described by the contracting authority, indicating that the solutions proposed are technically, qualitatively and functionally equivalent.

The contracting authority does not limit the catalog of evidence to contractors by which they will demonstrate the equivalence of the solutions offered. Demonstration of equivalence is the contractor's obligation, but also his right. According to the content of art. 30 paragraph 5 of the Public Procurement Law: "The Contractor who refers to equivalent solutions described by the Employer is obliged to demonstrate that the supplies, services or works offered by him meet the requirements specified by the Employer." The description of the proposed equivalent solutions is enclosed with the offer only by the contractor who offers equivalent products.

7. Regulations relating to subcontractors:

a) The contractor may entrust the performance of part of the contract to a subcontractor (in accordance with Article 36a paragraph 1 of the Public Procurement Law). In this case, the contracting authority in accordance with art. 36b. paragraph. 1 of the Act requests the contractor to indicate

In the offer form (Annex No. 1 to the ToR) of the part of the contract which it intends to entrust to subcontractors and the submission of subcontractors' companies (if known).

b) Entrusting the performance of part of the contract to subcontractors does not release the contractor from liability for the proper performance of this contract. The Contractor is responsible for the actions, defaults and negligence of subcontractors to the same extent as if they were the acts, defaults or negligence of the Contractor.

Along with the invoice for the services rendered, the Contractor shall submit a document confirming the settlement of services performed with the Subcontractor along with the Subcontractor's statement confirming the lack of financial claims against the Ordering Party for the specific size of services provided by the Subcontractor.

c) If the contracting authority finds that there are grounds for exclusion for a given subcontractor, the contractor shall be obliged to replace this subcontractor or to refuse to entrust the performance of part of the subcontractor's contract.

d) Provisions regarding the contracting authority's requirements regarding subcontracts and the rules for concluding such contracts are included in the model contracts for task I and task II.

9. Information on the protection of personal data (pursuant to Article 13 of the GDPR):

Your personal data will be processed on the basis of art. 6 clause 1 lit. c GDPR for the purpose related to the procedure for the award of a public contract for the provision of services for the collection and management of solid municipal waste: unsorted and segregated for 2019, divided into two independent tasks, No. 38/18 / N, conducted in an open tender;

The recipients of your personal data will be persons or entities to whom documentation of proceedings based on art. 8 and art. 96 section 3 of the Act of 29.1.2004 - Public Procurement Law (Journal of Laws of 2017, item 1579 and 2018), hereinafter the "PPL Act";

Your personal data will be stored in accordance with art. 97 paragraph 1 of the Public Procurement Law, for a period of 4 years from the date of termination of the contract award procedure, and if the duration of the contract exceeds 4 years, the storage period covers the entire duration of the contract;

The obligation for you to provide your personal data directly related to you is a statutory requirement specified in the provisions of the Public Procurement Law, related to participation in a public procurement procedure; the consequences of not providing specific data result from the Public Procurement Law;

With regard to your personal data, decisions will not be taken in an automated manner, applying to art. 22 GDPR;

- based on art. 15 GDPR, the right to access your personal data;

- based on art. 16 GDPR, the right to rectify your personal data **;

- based on art. 18 GDPR, the right to request the administrator to limit the processing of personal data, subject to the cases referred to in art. 18 clause 2 GDPR ***;

- the right to lodge a complaint to the President of the Office for Personal Data Protection, if you feel that the processing of your personal data violates the provisions of the GDPR;

You are not entitled to:

- in connection with art. 17 clause 3 lit. b, d or e RODO the right to delete personal data;

- the right to transfer personal data referred to in art. 20 GDPR;

- based on art. 21 GDPR, the right to object to the processing of personal data, because the legal basis for the processing of your personal data is art. 6 clause 1 lit. c GDPR.

The Contractor, when applying for the award of a public contract, is obliged to fulfill all formal and legal obligations related to participation in the procedure. These duties include obligations arising from the GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (general data protection regulation OJ L 119, 4.5.2016, p. 1), in particular the information obligation provided for in art. 13 GDPR towards natural persons to whom the personal data relate and from whom the contractor has directly obtained the data. However, the information obligation arising from art. 13 GDPR will not apply if and to the extent that the data subject already has this information (see: Article 13 (4)). In addition, the contractor will have to fulfill the information obligation under Article 14 GDPR for natural persons whose data it provides to the contracting authority and whose data it has indirectly acquired, unless at least one of the inclusions referred to in art. 14 paragraph 5 GDPR. In order to ensure that the contractor has completed the abovementioned information obligations and protection of legally justified interests of a third party, whose data have been provided in connection with the participation of the contractor in the proceedings, the Employer obliges the contractor to submit in the public procurement procedure a declaration that he has fulfilled the information obligations provided for in art. 13 or art. 14 GDPR (the content of the declaration required of the contractor in fulfilling his information obligations provided for in Article 13 or Article 14 of the GDPR has been included by the contracting authority in the template of the offer form - Annex 1 to the ToR).
