The object of the order is the maintenance, repair and modernization of traffic traffic traffic lights in the territory of the city of Bytom in a period of 24 months
1. The object of the order is the maintenance, repair and modernization of traffic lights in the territory of the city of Bytom in a period of 24 months
2. The subject of the contract and the method of its implementation shall be defined by the Detailed Description of the Order Subject (hereinafter SOPZ), constituting Annex No 3 and the Designed contractual provisions constituting Annex 13 to the SWZ.
The list of signalling in the city of Bytom and the list of radar plates with the message “RELEASE — THANK” for the period 2022 to 2023 are shown in Annex 4 to SWZ.
3. The Contractor shall proceed to remove the signalling failure (i.e., take corrective action on the facility) within a period of not more than 120 minutes after notification by the Contracting Authority or the Police. Accordingly, the Contractor will be required to provide a 24-hour telephone service (also on Sundays, holidays and days off work)
in order to contact the Ordering Party. In situations of destruction of municipal property (need to replace signalling elements), the Contractor shall proceed to repair the facility after prior agreement with the Ordering Party.
The time of accession to the removal of signalling failure shall be one of the criteria for the evaluation of tenders referred to in Chapter XXII of the SWZ.
4. Removal of traffic lights failures, replacement of worn components and modernisation will be carried out on the basis of the transfer protocols of work (except for the lump sum work specified in the Description of the Object of the Order).
5. When carrying out work, the Contractor is obliged to comply with the rules and conditions for placing road safety signs and devices specified
in Annexes Nos 1, 3, and 4 to the Regulation of the Minister of Infrastructure of 3 July 2003
on specific technical conditions for traffic signs and signals and road safety equipment and conditions for their placement on roads (Journal of Laws No 220, item 2181 as amended).
6. The Contractor is obliged to have an entry in the BDO Register or a signed contract with an entity that is entered into the BDO and is obliged to dispose and/or use materials from demolition (waste). At the same time, the Contractor pursuant to Article 3 (1) (19) and 32 of the Laws of 14 December 2012 on waste (t. Journal of Laws 2021, item 779 as amended) is the manufacturer and holder of waste and undertakes to dispose and/or use in accordance with applicable law in the a way that ensures respect for the natural environment. The Contractor undertakes to account of the above activities with the Contracting Authority by submitting a declaration of disposal and/or management of such waste before the end of the contract.
7. Any newly installed or built materials must be factory new (available in the manufacturer's current offer) and have declarations of compliance with the Polish Standard, technical approvals or European technical approvals or certificates issued by authorised bodies.
8. In the event of decommissioning or taking over traffic traffic traffic traffic traffic traffic traffic traffic traffic traffic traffic, the monthly remuneration for its ongoing maintenance will be determined in proportion to the time during which this maintenance took place.
Example:
monthly remuneration for ongoing maintenance is PLN 1.600,00, and this signalling was eliminated on the 23rd day of the month. Thus the remuneration is: (1.600,00:30) x 23 = PLN 1226.67
or
monthly remuneration for current maintenance is 1,600,00 PLN gross and signaling
This was taken over on the 23rd day of the month — remuneration is: (1.600,00 zł: 30) x 8 = 426.66 gross.
10. The Contracting Authority shall not allow the submission of partial tenders.
11. The Contracting Authority shall not permit the submission of variant tenders and in the form of electronic catalogs.
12. The Contracting Authority does not provide for a requirement to submit an offer after the local vision or to check the documents necessary for the execution of the contract.
