The CPS in conjunction with the Serious Fraud Office (SFO), the National Crime Agency (NCA) and The Public Prosecution Service for Northern Ireland (PPSNI) have placed a Framework agreement for a panel of office-holders who will act on a range of confiscation and civil recovery related matters across England, Wales and Northern Ireland.
Office-holders will be drawn from the panel on a case-by-case basis, will be appointed by the High Court or the Crown Court (depending on the legislative scheme covering the case) upon the application of the CPS. Professionally qualified, they have significant investigative, asset management and enforcement experience.
This Framework Agreement runs for 3 years with a 1 year extension period.
Interim Receivership in civil recovery cases. Interim receivers need to have similar skills and expertise to those of Management Receivers and CRMR’s together with the ability to investigate whether or not the property which is the subject of the order is property obtained through unlawful conduct such that it gives the contracting Body the basis for a claim for a civil recovery order.
Management receiver in civil recovery cases will comprise firms with expertise that will, taken together, be able to manage assets that have been restrained or frozen pursuant to a restraint order or Property Freezing Order (“PFO”), respectively in the Crown Court and High Court.
Enforcement receivers, NCA receivers and trustees for civil recovery. Their skills will, taken together, enable them to engage in the enforcement of final orders and recover assets pursuant to those orders.
