The subject of the contract is a comprehensive supply of electricity – delivery and distribution service for the Szydłowo Commune and organizational units in the period from 01.01.2024 to 31.12.2024 – up to 197 consumption points (PPE) with a total estimated volume of 1 171 601 kWh.
1. The subject of the contract is a comprehensive supply of electricity – delivery and distribution service for the Municipality of Szydłowo and organizational units in the period from 01.01.2024 to 31.12.2024 – up to 197 consumption points (PPE) with a total estimated volume of 1 171 601 kWh.
2. A detailed description of the subject of the contract is a list of electricity consumption points – Annex 1 to the SWZ. The indicated electricity consumption is a declared and estimated amount used only to calculate the price of the offer, compare the submitted offers and select the Contractor.

3. The Ordering Party informs that the electricity consumption points specified in the description of the subject of the contract to SWZ have a comprehensive electricity sales agreement with ENEA S.A. concluded for a definite period until 31 December 2023.
4. Distribution costs have been determined by the Ordering Party on the basis of the volume of energy and the currently applicable rates for energy distribution in accordance with the tariff of Enea Operator sp. z o.o.
For PPE in C2x tariffs there is a one-month billing period.
For PPE in C1x tariffs there is a two-month settlement period.
The energy seller is ENEA S.A.
5. The Ordering Party reserves the right to increase or decrease the amount of PPE and to change tariff groups or contractual capacity for facilities.
6. The Contractor, based on the Power of Attorney granted, will be obliged to report the contract on its own behalf and the contracting authority to the relevant DSO in accordance with applicable regulations and to represent it before the DSO in the process of changing the seller.
7. The condition for starting electricity supplies within the indicated time (for individual PPE) is the positive completion of the procedure of changing the seller.

9. The Ordering Party shall not divide the contract into lots. Dividing the contract into lots would result in excessive organisational difficulties for the contracting authority. Given the situation on the electricity market, dividing the contract into lots could result in no bid for one of the lots. The procedure covers facilities (e.g. water and sewage management facilities) to which the contracting authority must ensure continuity of supply.
10. The contracting authority reserves the right to use Article 139(1) of the Public Procurement Law, i.e. the possibility of first examining and evaluating bids, and then selecting the contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
