1. The subject matter of the contract shall constitute a task called:
"Removal of hazardous waste deposited in two car parks in Dąbrowa Górnicza in the area of Kasprzaka 70 street – on the square and in the semi-trailer (plots no.: 8139, 8127 precinct 0020 Dą-browa Górnicza II) and their neutralization".
2. The Contractor is obliged to perform a complete service of removal and disposal of all MAUSER containers with hazardous waste – in the amount of 21 pcs. Hazardous waste is deposited on the property located in Dąbrowa Górnicza in the area of Kasprzaka 70 – plot number 8127 – continuation in section II.2.4. Announcements.

3. In the Chemical-Toxicological Opinion of 2020 – Annex 10 to the SWZ, the following probable codes were assigned to waste:
- 07 01 01* (wash waters and mother liquois)
- 07 01 04* (other organic solvents, washing solutions and mother liquor).
- 07 01 07*(Distillation and reaction residues containing halogen compounds)
- 07 01 08* (other distillation and reaction residues)
- 07 03 01* (wash waters and mother liquors)
- 07 03 04* (other organic solvents, washing solutions and mother liquids)
- 07 03 07* (distillation and reaction residues containing halogen compounds)
- 07 03 08* (other distillation and post-reaction residues).
- 08 01 11* (waste paints and varnishes containing organic solvents or hazardous substances)
- 08 01 12 (waste paints and varnishes other than those mentioned in 08 01 11)
- 08 01 13 * (sludges from the removal of paints and varnishes containing organic solvents or other dangerous substances)
- 08 01 17* (waste from the removal of paints and varnishes containing organic solvents or other substances)
- 08 01 19* (aqueous suspensions of paints or varnishes containing organic solvents or other dangerous substances)
- 14 06 03* (other solvents and mixtures of solvents).
4. The estimated amount is (21 pcs. x 1.4 Mg/m3) 29.4 Mg. The amount of waste covered by the contract is an estimate and may change. The settlement of the task will concern the amount of waste actually received, transported and disposed of.
Other requirements regarding the implementation of the subject of the contract are included in §2 and §3 of the draft contract constituting Annex 6 to the SWZ.

II. Equivalent solutions.
1. If the Contracting Authority in the description of the subject of the contract has indicated trademarks, patents or origin, sources or a specific process that characterizes products or services provided by a specific contractor, it is allowed to offer solutions equivalent to those described, provided that they maintain the same minimum technical, quality and functional parameters, etc.
2. An economic operator who relies on equivalent solutions shall be obliged to demonstrate that the solution offered by it meets the requirements specified by the contracting authority. In this case, the contractor shall attach to the tender a list of equivalent solutions together with its description or standards.
3. If the description of the subject of the contract contains references to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the PPL, the Contracting Authority shall allow solutions equivalent to those described.
4. Wherever specific standards and regulations are referred to in tender documents to be met by materials, equipment and other goods and services rendered and examined, the provisions of the most recent edition or revised edition of the said standards and regulations shall apply, unless otherwise provided in the terms of the contract.
5. Where those standards and regulations are national or refer to a specific country or region, other relevant standards may also be applied to ensure an equal or higher level of performance than those referred to when they are checked and approved. Differences between the mentioned standards and their proposed replacements must be accurately described by the Contractor.
