The subject of the contract is the supply of electricity within the meaning of the Act of 10 April 1997 Energy Law (i.e., Journal of Laws of 2019, item 755, as amended) for the needs of awarding entities with the total volume: 18 121 447.00 kWh in the delivery period, i.e. not earlier than from 01/01/2020 to 31/12/2020, with the proviso that the supply to the individual electricity consumption points will start not earlier than after the effective termination of the existing energy supply agreements and the successful completion of seller switching procedure.

1. The subject of the contract is the supply of electricity within the meaning of the Act of 10 April 1997 Energy Law (i.e., Journal of Laws of 2019, item 755, as amended) for the needs of awarding entities with the total volume: 18 121 447.00 kWh during the supply period, i.e. not earlier than from 01/01/2020 to 31/12/2020, with the proviso that the supply to individual electricity consumption points will start not earlier than after the effective termination of existing energy supply agreements and successful change of seller procedure.

2. The tender procedure will be conducted by the Małopolskie Voivodship on behalf of and for the benefit of voivodship self-government organizational units, voivodship legal entities which have concluded an agreement with the Marshal's Office of the Malopolska Voivodship for this purpose.

3. Energy supply will take place on the basis of contracts concluded separately by individual Purchasers.

4. Distribution services will be provided on the basis of separate contracts concluded with local Distribution System Operators.

5. The electricity supplied must meet technical standards in accordance with the provisions of the Energy Law of 10 April 1997 (i.e. Journal of Laws of 2019, item 755, as amended), executive acts and Polish Standards.

6. The Ordering Party also informs that it currently has contracts for the sale of energy, concluded as comprehensive contracts, and exclusively for sales, after another change of seller. Information on the contracts is included in Annex 4a to the ToR.

7. The terms of the contract are included in the contract template constituting Annex 3 to the ToR.

8. The contracted capacity together with the reserve connection for all outlets is currently: 10,770.10 KW.

9. The list of delivery places with technical data is specified in Annex 4a to the ToR. The list of units together with the volume is attached as Annex 4b.

10. The missing numbers of current contracts for the sale of electricity will be completed no later than on the day of concluding the contract with the new seller.

11. A list of individual tariff groups with a breakdown into electricity consumption in specific time zones is attached as Annex 5 to the ToR.
