5) The total estimated volume of electricity demand for 2 PPE of the Ordering Party during the term of the contract is 2 250 MWh. The volume was calculated on the basis of forecasted consumption, is indicative and does not constitute an obligation for the Ordering Party to purchase electricity in the given quantities.

3. The Contractor shall be responsible for the quality, compliance with the technical and quality conditions described for the subject of the order.

The volume was calculated on the basis of forecasted consumption, is indicative and does not constitute an obligation for the Ordering Party to purchase electricity in the given quantities.
6) During the term of the contract, the Contracting Authority reserves the right to change the tariff group and contractual power valued in the submitted offer and will be settled according to the prices specified in the Contractor's offer
7) Demarcation of ownership: current terminals on current transformers n.n. from the side of supplying the switchboard n.n of the 15/0.4 kV transformer station located on the premises of the ordering party.
8) The Ordering Party's measuring and billing systems are adapted to the TPA service.
9) Settlement for the sold electricity will be based on metering and settlement indications.
10) As part of the subject of the contract, the Contractor shall be obliged to:
A) supply electricity in accordance with applicable laws, in particular the provisions of the Energy Law of 10 April 1997 (i.e. Journal of Laws of 2022, item 1385, as amended) together with executive regulations issued to this Act and in accordance with applicable quality standards and norms;
B) provide electricity sales for the existing PPE of the Ordering Party and for new PPEs, which the Ordering Party will be able to connect to the DSO network;
(C) act as a trade balancing party for the sale of electricity;
D) ensure during the execution of the order quality standards of the Ordering Party's service, in accordance with the applicable provisions of the Energy Law and relevant regulations to this Act in the field of maintaining quality standards of service;
E) accept from the Ordering Party and consider notifications and complaints regarding the settlement of electricity sold;
F) inform the Ordering Party about the circumstances preventing or delaying the change of the seller together with the reason and provide.
3. Distribution services shall be provided on the basis of a separate agreement concluded by the Ordering Party with the Relevant Distribution System Operator.
4. The Contractor applying for the contract must have an agreement with the Distribution System Operator enabling the sale of electricity via the DSO distribution network to the Ordering Party's facilities.
5. The Ordering Party declares that it has the legal title to use the facility located at 1 Szpitalna Street in Tarnobrzeg.

7. The given value of energy consumption specified in Annex 2 to the CMS is an estimate, given in order to determine
