1. The subject of the contract is the supply of electricity to the facilities of the municipalities of Czernichów, Igołomia-Wawrzeńczyce, Kocmyrzów-Luborzyca, Liszki, Michałowice, Mogilany, Świątniki Górne, Wielka Wieś and Zabierzów, with a total estimated volume of 49 970 546 kWh (+/- 10%) in the delivery period, i.e. from 01.01.2024 to 31.12.2025 separately for each metering system, but not earlier than after the effective termination of the existing energy supply agreements and positively carried out the procedure of changing the seller.
2. A detailed description of the subject of the contract, including the list of facilities referred to in paragraph 1 and the planned electricity consumption, is included in Annexes 9, 10 and 11 to the SWZ.
3. The sale of electricity shall take place under the conditions specified in the provisions of the Act of 10 April 1997. Energy Law (consolidated text: Journal of Laws of 2022, item 1385, as amended) and in accordance with the implementing regulations issued to this Act.

3. The sale of electricity shall take place under the conditions specified in the provisions of the Act of 10 April 1997. Energy Law (consolidated text: Journal of Laws of 2022, item 1385, as amended) and in accordance with the implementing regulations issued to this Act, in particular with the standards of customer service specified in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819). The standards of contract performance are set out in these legal acts.
4. The Contractor who wins the tender undertakes to submit, on behalf of the Contracting Authority, the Distribution System Operator responsible for the Contracting Authority, a notification of the conclusion of a contract for the sale of electricity to individual facilities.
5. The Contracting Authority reserves the possibility to withdraw from the sales contract for facilities where, due to the performance of the RES installation, a comprehensive contract will be necessary.
6. The Contracting Authority requires that, in accordance with Resolution No. XXV/373/20 of the Regional Assembly of the Malopolska Region of 28 September 2020 on the Air Quality Plan for the Malopolska Region, electricity supplied to public buildings comes from renewable sources.
