Purchase of electricity for the Purchasing Group, which includes facilities belonging to: UAM, UMP, AWF, UPP, UEP, UAP. The contract was divided into 3 parts: Part 1 – purchase of electricity for tariff group B, Part 2 – purchase of electricity for tariff group C, Part 3 – purchase of electricity for tariff group G. The order quantity specified in the Terms of Reference is an estimate calculated on the basis of the current electricity consumption and specifies the quantities on the basis of which contractors are obliged to calculate the price of their offer. The actual energy consumption during the term of the contract may be less than the value specified in the Terms of Reference. The Contracting Authority does not envisage awarding contracts referred to in Article 214(1)(7) and (8) of the Public Procurement Act.

Purchase of electricity for tariff group B in the total amount of approximately 39,480 MWh, including 30,472 MWh in 2024, 9,008 MWh in 2025, with expected purchases by individual units:

•UAM – 20 866 MWh/13m-cy (2024r.–16 049 MWh i 2025r.–4 817 MWh)

•UMP – 10 636 MWh/13m-cy (2024r. – 8 182 MWh at 2025r. – 2 454 MWh)

•AWF – 2 058 MWh/13m-cy (2024r. – 1 583 MWh i 2025r. – 475 MWh)

•UPP – 3 089 MWh/13m-cy (2024r. – 2 510 MWh i 2025r. – 579 MWh)

•UEP – 2 831 MWh/13m-cy (2024r. – 2 148 MWh at 2025r. – 683 MWh)

The contract size specified above is an estimate calculated on the basis of previous electricity consumption and determines the amounts on the basis of which contractors are obliged to calculate the price of their tender. Actual energy consumption during the term of the contract may be less than the value specified above. Detailed information on individual points of electricity consumption is presented in the summary table constituting Annex 2 to the SWZ.

RIGHT OF OPTION: The Contracting Authority indicates that with regard to the performance of the subject matter of the contract covered by this contract, it provides for the right of option referred to in Article 31(2) and Article 441(1) of the Public Procurement Act. The right of option for this contract is based on the fact that the Contracting Authority is obliged to purchase only a part of the supplies covered by this order (basic order), while with respect to the remaining scope it may purchase these supplies, but is not obliged to do so (optional order). The Contracting Authority indicates that the minimum amount of electricity that will certainly be used by the Contracting Authority is 75% of the maximum amount of electricity referred to in § 3 section 1 a) of Appendix No. 9 to the Terms of Reference (Draft Provisions of the Agreement), as the minimum (basic) order. The remaining amount of electricity (25%) is an option within the meaning of the Public Procurement Law, i.e. the Contracting Authority does not have to perform it, while the Contractor is obliged to perform the scope of performance required by the Contracting Authority under the option.

Purchase of electricity for tariff group C in the total amount of approximately 17,314 MWh, including 13,631 MWh in 2024, 3,683 MWh in 2025, with expected purchases by individual units:
