1. The subject of the contract is the collection and management of municipal waste from the owners of real estate where residents live, located in the Municipality of Legionowo, from the Point of Selective Collection of Municipal Waste and expired medicines from pharmacies in a way that ensures the achievement of appropriate levels of recycling, preparation for re-use and recovery by other methods and reduction of the weight of biodegradable municipal waste transferred to Storage.
2. The Contractor shall comply with legal provisions during the term of the contract, in particular:
a) the Act of 14 December 2012 on waste,
b) the binding resolution of the Legionowo City Council on the regulations for maintaining cleanliness and order in the Legionowo Municipality,
c) the binding resolution of the City Council of Legionowo on determining the detailed manner and scope of providing services in the field of collecting municipal waste from owners of real estate in the Municipality of Legionowo where residents live and managing this waste, in exchange for a fee paid by the property owner for municipal waste management,
d) provisions of the Provincial Waste Management Plan for Mazovia.
3. A detailed description of the subject of the contract is attached as Annex 13 to the SWZ, which specifies the subject of the contract.
4. The contracting authority specifies in §24 SWZ the requirements (pursuant to Article 95 of the PPL) related to the performance of the contract in the scope of employment by the contractor or subcontractor on the basis of an employment relationship of persons performing activities indicated by the contracting authority in the field of contract performance, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974. The Labour Code, i.e. "By establishing an employment relationship, the employee undertakes to perform work of a specific type for the employer and under his direction and at the place and time designated by the employer, and the employer - to employ the employee for remuneration" in accordance with the characteristics of the employment relationship according to the National Labor Inspectorate:
• subordination of the employee to the management of the employer,
• payment of work,
• the work is performed personally by the employee,
• repeatability of activities in specific time periods,
• economic, social and economic risk of the production process,
• the work is carried out at a place and time designated by the employer.
