1. The subject of the Order is the comprehensive execution of construction works related to the implementation of two tasks:

1) construction of the retaining structure of the turnout chamber "Fabryczna" (Task No. 1) and

2) construction of the retaining structure of the "Retkinia" chamber (Task No. 2)

– as part of the implementation of the Internal Project. entitled: "Construction of a long-distance tunnel in Łódź along the railway line No. 85 with inclusion in railway line No. 14".

2. The detailed scope of the Subject of the Order and the material scope of works to be performed as part of the Contractor's obligations is indicated in the PFU, constituting Annex 1 to the SWZ.

I. The subject of the Order is the comprehensive execution of construction works related to the implementation of two tasks:

1) construction of the retaining structure of the turnout chamber "Fabryczna" (Task No. 1) and

2) construction of the retaining structure of the "Retkinia" chamber (Task No. 2)

– as part of the Internal Project: "Construction of a long-distance tunnel in Łódź along the railway line No. 85 with inclusion in railway line No. 14".

II. The subject of the Order includes in particular:

1) preparation of Design Documentation (in particular Executive Documentation) on the basis of the Construction Project (PB) provided by the Contracting Authority for "Construction of a long-distance tunnel in Łódź along railway line No. 85, including inclusion in railway line No. 14":

a) section: "Factory Chamber" covering the construction of the "Fabryczna" turnout chamber and the railway line, together with the infrastructure necessary for the construction and operation of the tunnel, chamber and railway line (Stage I) and comprehensive documentation, including construction design and executive documentation for the reconstruction of the water supply network (DN200 water supply) – the section from the connection supplying the building of the Łódź House of Culture (ŁDK) to inclusion in the area of Sienkiewicza Street;

(b) the section "Retkinia Chamber" comprising the construction of the turnout chamber "Retkinia" and the railway line, together with the infrastructure necessary for the construction and operation of the tunnel, chamber and railway line (Stage I);

2) comprehensive execution of works and temporary works necessary for the execution of construction works described in the PFU together with attachments, including the development of the project and execution of the Temporary Traffic Organization;

3) comprehensive execution of construction works, based on the design documentation developed by the Contractor, referred to in point 1) above, including all preparatory works necessary for the implementation of the Agreement and the performance of all activities required by generally applicable law, standards, principles of technical knowledge and construction art.

III. The detailed scope of the Subject of the Order and the material scope of works to be performed as part of the Contractor's obligations is indicated in the PFU, constituting Annex 1 to the SWZ.

IV. The Contracting Authority provides for the award of contracts referred to in Article 388(2)(c) of the PPL Act (hereinafter: Similar Procurement) in respect of all industries and works indicated in the PFU, the total value of which will not exceed 50% of the net value of the Contract.

The Contracting Authority shall award the contract referred to in Article 388(2)(c) of the PPL Act on terms analogous to those specified in the Draft Agreement, constituting Annex 2 to the SWZ, with the proviso that the amount of the performance bond in the scope of the Similar Order will be calculated from the value of the Similar Order; the amount of contractual penalties specified as a percentage will be calculated accordingly from the value of the Similar Order and negotiations will be subject to, m.in: payment rules, deadline, acceptance procedures, rules of coordination on the construction site with other contractors and other issues important due to the specificity and scope of the Similar Order.

V. Deadline for performance of the Subject of the Agreement:

1) for Task No. 1 – 397 calendar days from the date specified as the date of commencement of works – completion of construction works along with the transfer of the construction site by the Contractor to strengthen the foundations of ŁDK,

2) for Task No. 2 – 337 calendar days from the date of conclusion of the Agreement, with the proviso that the completion of construction works along with the transfer of as-built documentation and the handover of the chamber to the TBM tunnel contractor together with the takeover of monitoring is to take place within 300 calendar days from the date of conclusion of the Agreement.

Detailed deadlines for the execution of the subject of the Order are specified in the Draft Agreement and Annexes 4A and 4B ("Work Implementation Schedule") to PFU.
