Description:
Purchasing group. Supply of electricity in the period from 01.2020 to 31.12.2020.

The subject of the contract is the supply of electricity in the period from 1.1.2020 to 31.12.2020 to 347 consumption points (PPE) with a total estimated volume (+/- 10%) of 3,230.32 MWh, of which: zone I 1,907.00 MWh; zone II 1,020.65 MWh; zone III 302.67 MWh.

1. The subject of the contract is the supply of electricity in the period from 1.1.2020 to 31.12.2020 to 347 consumption points (PPE) with a total estimated volume (+/- 10%) of 3,230.32 MWh, of which

zone I 1,907.00 MWh

zone II 1,020.65 MWh

zone III 302.67 MWh

The forecast electricity consumption indicated above is indicative and may differ from the amount of energy actually consumed during the contract period. Reducing or increasing the amount of energy consumed does not entail any consequences for the contracting parties (recipients), except for the need to pay for the energy actually consumed at the rates specified in the Contract.

2. Quality standards: The subject of the contract is the supply of electricity with specified quality standards in accordance with applicable regulations.

The quality standards of electricity are described in the Act of 10.4.1997 - Energy Law and in the Regulation of the Minister of Economy of 4.5.2007 on detailed conditions for the functioning of the power system (Journal of Laws of 2007 No. 93, item 623, as amended). The rules for shaping and calculating tariffs and settlements in electricity trading are set out in the Regulation of the Minister of Energy of 6.3.2019 (Journal of Laws of 2019, item 503, as amended)

3. The following billing periods are customarily used:

tariff group C1x, Gx, R - 2 (two) months

tariff group C2x, Bx - 1 (one) month

The measuring systems with the tariff group B are adapted to the procedure of changing the seller.

4. Distribution services will be provided on the basis of separate agreements concluded between the awarding entities (electricity recipients - hereinafter "Consumers") and the distribution system operator (DSO).

5. Distribution system operator - as described in Annex 1 to the ToR, column "Distribution system operator".

6. The Contractor, based on the Power of Attorney granted, will be obliged to submit electricity sales contracts to the appropriate DSO in accordance with applicable regulations on behalf of the contracting authority (customers).

Note: The Contractor shall report the consumption points solely on the basis of the data (provided after the conclusion of the contract for the sale of electricity) by the ordering party or its Proxy to change the seller.

7. The condition for starting the supply of electricity by the indicated date (in relation to individual consumption points) is the positive conduct of the supplier switching procedure, the customer's possession of a valid contract for the provision of electricity distribution services and the effective expiry of existing contracts for the sale of electricity. Sales contracts are concluded for a definite period of time, and their term expires on the day preceding the planned delivery start date - as described in Annex 1 to the ToR "Delivery period".

8. For all PPEs, there will be a change of seller once again. The current contracts for the supply of electricity will expire on the day preceding the planned date of commencement of supplies (column "Delivery period").

9. In the event that during the term of the contract there are changes in the scope of the buyer / recipient requiring the conclusion of a new distribution contract, the contractor will be required to submit a DSO statement of consent to conclude contracts for the provision of distribution services or to conclude a distribution contract on behalf of the recipient, to which the contracting authority grant the appropriate power of attorney.

10. In Annex 1 to the ToR, the addresses to which invoices should be sent are indicated in the "Buyer" and "Consignee (invoice sending address)" columns. Data regarding the issue and delivery of invoices will be included in the Electricity Supply Agreement / Annex to the Agreement.
