1. The subject of the contract is a comprehensive supply of gaseous fuel together with a gas distribution service, i.e. high-methane gas with symbol E to gas consumption points of organizational units of the City of Kalisz and other entities for the purposes of a joint contract conducted pursuant to Article 37 paragraph 2, Article 38 paragraph 1 and Article 41 of the Public Procurement Law, carried out on the basis of a comprehensive agreement, referred to in Article 5(3) of the Act of 10 April 2007. Energy Law (Journal of Laws of 2022, item 1385, as amended, hereinafter referred to as the "Energy Law") and as part of a comprehensive service within the meaning of Article 3(30) of the Energy Law.

2. The entities covered by this proceeding, hereinafter referred to as "End Recipients" in the SWZ, are indicated in point 4.3 of the SWZ.

3. Deadline for performance of the contract: The contract will enter into force on the day of signature. However, the supply of gaseous fuel will start from 01.01.2024, with the proviso that not earlier than after fulfilling the condition of effective termination or termination of the current comprehensive contract for the supply of gaseous fuel and after a positive procedure of changing the supplier for each point of consumption. Carrying out the procedure of changing the seller is the responsibility of the Contractor. The date of completion of gas fuel deliveries is indicated as 31.12.2024. The indication of the date of performance of the contract is justified by the need to complete all substantive activities by the end of the financial year, since the task is one-year.

5. The procedure referred to in this announcement is conducted in an open tender procedure in accordance with Article 132 of the Act of 11.09.2019. Public Procurement Law (Journal of Laws of 2022, item 1710, as amended, referred to in this announcement as the "Act", "PPL Act" or "PPL"), and the procedure referred to in Article 139(1) of the Act will apply in the proceedings.

6. The offer shall be drawn up under pain of nullity in electronic form and shall be accompanied by a qualified electronic signature of the person(s) entitled to make declarations of will on behalf of the Contractor. The offer is submitted before the deadline for submitting offers exclusively via the Platform.
