The proceedings are conducted with a view to concluding a framework agreement. The subject of the framework agreement is to define the framework conditions for the award and performance of executive contracts during the term of the framework agreement consisting in the provision of consultancy services by the Contractor. The Ordering Party reserves that the implementation of the subject of the framework agreement will take place in accordance with the actual needs of the Ordering Party. In the event of failure to perform all or part of the subject of the framework agreement, the Contractor shall not be entitled to any claim against the Ordering Party. The detailed scope of the executive contract and all conditions for the performance of the executive contract will be specified each time in the invitation to submit an executive tender and the executive agreement. A detailed description of the subject of the contract is set out in Annex 1 to the SWZ, while the conditions for the implementation of the subject of the contract are specified in the draft provisions of the framework agreement constituting Annex 2 to the SWZ.
1. The procedure shall be conducted with a view to concluding a framework agreement.
2. The subject of the Framework Agreement is to define the conditions for the award and performance of Executive Contracts consisting in the provision by the Contractor of consultancy services in the field of:
1) verification of the value of property rights or liabilities arising from reports or other documents constituting the basis for settlement of payments under Support Agreements, including GPS Agreements, in particular with respect to credit risk related to credit assets, non-credit risk related to credit assets, risk related to other assets;
2) verification of the manner in which the Beneficiary fulfils its obligations under the Support Agreements, including GPS Agreements, in terms of the provisions providing for the Beneficiary's obligation to ensure the consistency of processes applied to property rights covered by the Support Agreement with processes for other, similar property rights of the Beneficiary, and in the scope of monitoring and recovery of receivables, with particular emphasis on the effectiveness of debt collection activities and recovery costs in relation to receivables assumed, recognition and measurement of property rights and liabilities covered by the Support Agreement;
3) valuation of the property right or liability covered by the Support Agreement, including the valuation of the value of collateral for the property right, calculation of loss, justification for creating a revaluation write-off, provision, liability of the Fund towards the Beneficiary or occurrence of the Beneficiary's liability towards the Fund;
4) verification of the correctness of reporting of costs related to the acquisition of a cooperative savings and credit union or bank or recovery costs specified in the Support Agreement;
5) verification of the correctness of the use of the Assistance or Support granted;
6) verification of the conditions for the payment of funds under the Assistance granted or the Support granted;
7) valuation of the value of collateral under the Aid granted or the Support granted, in particular the correctness of the classification of credit receivables being the subject of the collateral.
3. The Ordering Party reserves that the implementation of the subject of the framework agreement will take place in accordance with the actual needs of the Ordering Party. In the event of failure to perform all or part of the subject of the framework agreement, the Contractor shall not be entitled to any claim against the Ordering Party.
4. The detailed scope of the executive contract and all conditions for the performance of the executive contract shall be specified each time in the invitation to submit an executive tender (Executive Invitation) and the executive agreement.
5. A detailed description of the subject of the contract is set out in Annex 1 to the SWZ, while the conditions for the implementation of the subject of the contract are specified in the draft provisions of the framework agreement constituting Annex 2 to the SWZ.
