The subject of the contract is the provision of a service consisting of the development of non-segregated (mixed municipal waste) and segregated municipal waste from real estate inhabited in the Municipality of Żagań with municipal status and from the Selective Collection of Municipal Waste in municipal installation or waste recovery and disposal plant. The Contractor shall carry out the order in accordance with the provisions of the law, in particular:
(a) the Waste Act of 14 December 2012 (Journal of Laws of 2021, item 779 as amended),
(b) the Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities
(c. Journal of Laws 2021, item 888 as amended). A detailed description of the item of the order is set out in Chapter 3 of the Order Terms Specification in paragraphs 3.1 to 3.8 and in the contract template as Annex 3 of the Procurement Terms Specification, which will be available after the publication of the contract notice in the Journal of Urz. The European Union.

(b) the Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities
(c. Journal of Laws 2021, item 888 as amended).
The Contractor shall be obliged to use the following fractions of municipal waste with codes:
• 20 03 01 - Unsegregated (mixed) municipal waste,
• 15 01 01 - Paper and cardboard packaging,
• 15 01 01 — Paper and cardboard packaging (contaminated),
• 15 01 07 - Packs of glass,
• 15 01 07 — Glass packaging (contaminated),
• 15 01 02, 15 01 04 — Metals and plastics, including plastic packaging,
• 15 01 02, 15 01 04 — Metals and plastics, including plastic packaging (contaminated),
• 20 01 10 - Clothing,
• 20 01 11 - Textiles
• 20 01 40 - Metals,
• 20 02 01 - Biodegradable waste,
• 20 02 01 - Biodegradable waste (contaminated),
• 20 03 07 - Bulky waste,
• 16 01 03 - Worn tyres,
• 17 01 01 - Concrete waste and concrete rubble from demolitions and repairs
• 17 01 02 - Brick rubble
• 17 01 07 - Mixed waste from concrete, brick rubble, waste ceramic materials and equipment elements other than those listed in 17 01 06
• 17 09 04 — Mixed waste from construction, repairs and dismantling other than those listed in 17 09 01, 17 09 02 and 17 09 03.
Municipal waste for the purpose of its development will be transmitted successively in quantities dependent on the amount of waste generated in the territory of Żagań and received by the entity providing the service for the collection and transport of municipal waste from the area of Żagań Municipality with urban status. Waste subject to the obligation to use in a municipal installation can only be developed in a municipal installation. The Contracting Authority shall require that the Contractor shall ensure that the procurement for the development of non-segregated (mixed) municipal waste, using a municipal installation for the processing of waste covered by the contract, as indicated in the list referred to in Article 38b (1) of the Act of on 14 December 2012 on waste (Journal of Laws of 2021, item 779 as amended). If the municipal installation operated by the Contractor and indicated in the tender will not be able to accept waste during the execution of this object of the contract, the Contractor shall indicate another municipal installation which shall accept municipal waste at the expense of the Contractor in the same date as provided for their delivery to the Contractor. In this situation, in the event of the need to transport municipal waste to another installation at a distance from the Municipality of Żagań with a municipal status greater than the installation distance of the Contractor, the Contractor will cover the difference in costs resulting from the need to transport municipal waste for a greater distance. The Contractor shall notify the entity that will supply the Contractor with waste for the purpose of development under this subject of the contract that it is not
able to accept the waste and will also indicate to that entity another municipal plant and the days and hours of receiving the waste by it at the latest on the first day of the period in which it will not be able to accept the waste.
