1) The subject of the contract is the successive purchase of liquid fuels, through refueling of vehicles and mechanical equipment at the disposal of the Ordering Party – ensuring non-cash, periodic settlement of transactions, at petrol stations, one of which should be located within a radius of 5 km from the headquarters of the contracting authority with the possibility of access for trucks with GVW over 18 tons, as well as at least 20 fuel stations in the Lower Silesian Voivodeship.
2) The Ordering Party requires the issuance of fuel cards assigned to a specific person. The list of persons for whom the Contractor will be obliged to issue fuel cards will be presented after selecting the most advantageous offer.

4) The quality requirements set out in PN-EN 228:2013-04 "Fuels for motor vehicles. Unleaded petrol" and PN-EN 590:2013-12 "Fuels for motor vehicles. Diesel oils" and the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680).
5) The Contracting Authority requires that the Contractor has in each province in the area of Polish min. 3 petrol stations with the possibility of making a non-cash purchase.
6) The indicated amounts of fuels are the maximum quantities to be achieved in the period from 01.09.2023. until 31.08.2026
7) Ordered quantities are subject to change. The Ordering Party allows the possibility of reducing the quantity of deliveries by no more than 60% in relation to the volume covered in a given part of the contract for a particular assortment, which does not cause changes in unit prices and cannot constitute grounds for claims of the parties in this respect and does not constitute a prerequisite for amending the contract. The contractor may then demand only the remuneration due for the part of the contract actually performed, and the reduction of remuneration will be calculated on the basis of the unit rates listed in the price estimate.
8) In relation to the subject of the contract, the Contracting Authority is entitled to commission the Contractor with an additional material scope covering the supply of liquid fuels the same (analogous) as described in the description of the subject of the contract ("Option"). The subject of the Option will be liquid fuel deliveries analogous to those described in the SWZ (and priced by the Contractor in the Offer). Under the Option, at the choice of the Contracting Entity, an additional supply of liquid fuels may be launched for all or some of them indicated in the SWZ (and priced by the Contractor in the Offer). The Ordering Party is not obliged to launch deliveries covered by the subject of the Option, and the Contractor is not entitled to claim their activation. Deliveries subject to the Option may be launched in an amount equivalent to up to 20% of the value of the subject of the contract determined in accordance with § 8 section 1 of the model contract constituting Annex 6 to the SWZ. The basis for determining the value of deliveries launched under the Option (in order to determine its scope) will be unit prices of individual aggregate fractions included in the Offer.
9) Other conditions for the performance of the contract are included in the model contract constituting Annex 6 to the SWZ.
