The object of the contract is to receive and use the whole mass of manufactured municipal waste both mixed and collected selectively, arising and collected from inhabited properties located within the administrative boundaries of the Mszczonów Municipality, regardless of the conditions atmospheric, in such a way as to ensure adequate levels of recycling, reuse and recovery are achieved by other methods and to reduce the mass of biodegradable municipal waste transferred to storage.

1. The object of the contract is to receive and use the entire mass of municipal waste produced both mixed and collected selectively, arising and collected from inhabited properties located within the administrative boundaries of the Mszczonów Municipality, regardless of the conditions atmospheric, in such a way as to ensure adequate levels of recycling, reuse and recovery are achieved by other methods and to reduce the mass of biodegradable municipal waste transferred to storage.

2. The Contractor shall be obliged to achieve the level of preparation for reuse and recycling of municipal waste in a given calendar year in respect of the mass of the municipal waste received by itself, in accordance with the Regulation of the Minister competent for Climate Affairs issued on the basis of Article 3b (3) of the Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities.

3. The item of the order was not divided into parts. The Contracting Authority shall not allow the submission of partial tenders.

4. The Contracting Authority shall not permit the submission of variant tenders and in the form of electronic catalogs.

5. Pursuant to Article 214 (1) (7) of the Law Pzp, the Contracting Authority provides for the repetition of similar services as for the basic contract in accordance with the subject of the basic contract, consisting of:

- scope of the order: Receipt and development of municipal waste from property owners residing in the Mszczonów Municipality.

- conditions for the award of the contract: the conclusion of a further contract for the collection and development of municipal waste from property owners residing in the Mszczonów Municipality for the period following the expiry of the contract concluded as a result of the conduct of this procedure.

The condition shall be fulfilled if the Contractor shows that he has:

(a) the current entry in the register of regulated activities in the field of collection of municipal waste from property owners referred to in Article 9b of the Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities (i.e.: Journal of Laws of 2021, item 888), as regards all the types of waste covered by this proceeding;

(b) the current entry in the register of entrants of products, products in packaging and waste management (register BDO) in accordance with the requirements of Article 49 (1) of the Waste Act of 14 December 2012 (i.e. Journal of Laws of 2021, item 779).

6. Pursuant to Article 95 (1) of the Pzp Act, the Contracting Authority requires employment by the Contractor, subcontractor or further subcontractor on the basis of the employment relationship, within the meaning of the Act of 26 June 1974 — Labor Code (i.e. Journal of Laws of 2020, item 1320), persons carrying out the following activities within the meaning of the order execution:

(a) workers performing a municipal waste management service;

(b) employees operating facilities of municipal waste processing facilities;

(c) workers carrying out waste sorting activities;

(d) persons carrying out activities involving the receipt of municipal waste from property (i.e. persons directed to load waste onto cars and drivers);

unless the services referred to in points a, b, c or d are carried out by the person concerned in the framework of his business activities.

7. Detailed requirements for the implementation and enforcement of the employment requirement under the employment contract are set out in the Model Agreement, constituting Annexes No 6, respectively.

8. A detailed description and method of execution of the contract shall include a description of the subject matter of the contract, hereinafter referred to as “SOPZ”, constituting Annex No 7 to SWZ and Model Agreement - Annex 6 to SWZ.

9. The applicable remuneration for the contractor will be a flat wage pursuant to Article 632 of the KC.

10. The Contracting Authority does not provide for a mandatory performance by the Contractor of a local vision.
