Comprehensive supply of high-methane natural gas (group E) including the sale and distribution of gas to the Marshal's Office of the Małopolska Region, voivodeship self-government organizational units and voivodeship legal entities for the years 2024 and 2025
1. The subject of the contract is a comprehensive supply of high-methane natural gas with the symbol E within the meaning of the Act of 10 April 1997 – Energy Law (i.e. Journal of Laws of 2022, item 1385, as amended). including the sale and distribution of gas with a forecast volume of approximately 102,070,610.00 kWh, counting over the delivery period, i.e. 24 months, with an effective date from 1 January 2024 after confirmation of this date by the Operator, provided that the process of switching the supplier is successfully carried out.
2. The tendering procedure will be conducted by the Lesser Poland Voivodeship on behalf of and for the benefit of provincial self-governing organizational units, provincial legal entities, which have concluded for this purpose an Agreement with the Marshal Office of the Lesser Poland Voivodeship.
3. Gas supply will be carried out on the basis of contracts concluded separately by the individual Ordering Party.
4. The quantity given in point 1 is the forecast size to be measured in the price offer. The projected consumption of gaseous fuel is estimated and is used only for comparison of bids.
5. The Contracting Authority provides for the possibility of exercising the right of option under this contract. Under the right of option, the contracting authority reserves the right to purchase additional quantities of natural gas in the event that the contracting authority's needs are greater than the indicated estimated amount of gaseous fuel for each of the gas intake points indicated in Appendix 4, the contracting authority reserves the right to increase the amount of gaseous fuel in each tariff group for each contracting authority in relation to the values specified in the appendix to the agreement. A statement on increasing the amount of gaseous fuel in a given tariff group in which there are gas consumption points will be submitted no later than by 30.11.2025.
6. The maximum estimated additional volume of gas that can be procured under the option – up to 20% of the volume specified in each contract.
7. The Contracting Authority has the right to increase the subject matter of the contract to the maximum specified quantity under the right of option, however, with the proviso that this is its right, which may or may not be exercised (in part or in full, depending on the needs).

A detailed description of the subject matter of the contract, m.in. addresses of consumption points, tariff groups, contracted capacity and forecast demand for gaseous fuel for individual units, is included in Appendix No. 1D to the Terms of Reference (Note: in one file there are separate sheets: the list of PPGs, the list of units participating in the procedure, the forecasted monthly consumption per PPG, the forecasted gas consumption for individual tariffs – monthly and annual).
