It is not an open procedure, but a so-called open house model! The form for the open procedure is only used because there is no form for the open house model. Contracts concluded in the open house model are not subject to public procurement law due to the lack of a selection decision. Submission to procurement regulations is not associated with the use of this form.

AOK Bayern intends to conclude non-exclusive rebate agreements with all interested pharmaceutical companies for the active ingredient allergen extracts with the trade name Oralair(R), ATC V01AA02, in accordance with § 130a (8) SGB V. AOK Bayern offers all interested pharmaceutical companies that meet the eligibility requirements mentioned below the conclusion of identical and non-individually negotiable discount agreements. The earliest possible contract start date is 01.12.2023, all contracts end on 30.11.2025. A contract can be concluded at any time during this term, but no later than 05.10.2025. Contracts can be terminated with one month's notice to the end of the month. In the event of the entry into force of a rebate agreement for medicinal products concluded in an open procedure by means of a nationwide or state-specific, open procedure for medicinal products with the active ingredient subject to the order, the open-house agreements automatically expire for the corresponding term. A contract will be concluded with all interested pharmaceutical companies, which will prove their suitability by completing and signing a self-declaration of reliability.

The pharmaceutical company must submit the completed and signed contract (the authorization of representation of the signatory(s) must result from the extract from the commercial register, otherwise a power of attorney must be submitted) together with the completed and signed annex "Determination of the contractual medicinal products" as well as the completed and signed self-declaration of reliability.

ELECTRONIC documents with a qualified electronic signature must be submitted via the communication area in the procurement portal www.dtvp.de.

If complete and correct documents are received by the 5th of each month, the contract shall commence on the following next first of the month, otherwise on the first day of the month after next. In the case of hand-signed documents in WRITTEN FORM, the complete, completed and signed documents must be sent in advance by fax (089/62730650151), as a scan to the e-mail address vergabestelle1@by.aok.de or via the communication area in the procurement portal www.dtvp.de within the deadline if the complete and correct original documents in paper form are received by the AOK Bayern, awarding office, by the 10th of the month.

Interested pharmaceutical companies can apply for the activation of the tender documents in the project room for the open house procedure on the www.dtvp.de portal. A link to the portal can be found in this notice.

Only pharmaceutical companies can be considered as potential contractual partners. The documents of the open-house procedure are only released to pharmaceutical companies as potential contractual partners and are to be treated as strictly confidential. By applying for activation by the companies, the confidential treatment of the documents is confirmed.
