For the calendar year 2024 and annually by lot, the BVG, as the sector contracting authority, will optionally tender for mileage services in rail replacement services (SEV) with buses provided by the Client in local public transport, which the Contractor organises and carries out independently. Temporary employment is not the subject of the
Tender. The service will be put out to tender in five separate but equivalent quantities.
A tender for a lot is made in such a way that the bidder submits a bid for one of five (quantity) lots; a specific lot number is not specified. We would like to point out to the bidders that, by way of derogation, the forms of the Client do provide for a determination of the lot number. Nevertheless, the Client will also include a bidder's bid entered in the tender form under lot number 1 in the evaluation for lots 2, 3, 4 and 5 if the bid is successful as a result of the
evaluation for Lot 1, i.e. the tender is not intended for the award of Lot 1.
A tender for five lots is submitted in such a way that the bidder submits a bid for five out of five (quantity) lots, again there is no specific determination of a specific lot number for one or the other tender. We would like to point out to the bidders that, by way of derogation, the forms of the Client do provide for a determination of the lot number. Nevertheless, the Client will include the bid with the lower total price in the evaluation for Lot 1 (or, in the case of identical prices for the 5 lots, the Client will take into account an offer of the bidder in the evaluation of Lot 1). If this bid with the lower total price is not successful in Lot 1, it will be included in the evaluation again for Lots 2, 3, 4 and 5; in this case, the tender with the higher total price would not be included in the evaluation as a whole, i.e. neither in the evaluation for Lot 1 nor for Lots 2, 3, 4 and 5. If the tender with the lower total price (or, in the case of identical prices, the evaluated bid) is successful in Lot 1, the evaluation for Lots 2, 3, 4 and 5 will include the further bid of the bidder in the evaluation.
ATTENTION: The BVG led to the topic of SEV benefits
already a procurement procedure with 2 lots by (see 2022/S121-345441), an award procedure with 4 lots (see 2022/S177-502452) and an award procedure with 5 lots (see 2022/S204-582942). The present call for tenders identifies five further lots of a single procurement requirement of the BVG
(i.e. a single public contract divided into a total of sixteen lots). With regard to the requirements of suitability, the two have already
lots (cf. points III.1.1. to III.1.3).

(1) The Contractor shall provide the mileage per lot with buses of the Client. For this purpose, the Contractor must independently organize and carry out the operation. The Contractor shall determine the preparation of the duty roster and personnel assignment as well as the place and time of the replacement of his or her driving personnel himself, in compliance with the statutory provisions, in particular the prescribed driving, break and rest times.
The timetable design of the AG will not be able to guarantee that the breaks of the deployed drivers according to FPersV, §1 para 3 fit in with the turnaround times (no 1/6 el capability). The driver must therefore be replaced by another driver during a block break. It is not possible to take a break on the bus.
(2) The mileage to be provided by the Contractor shall be as follows (per lot):
1. There is a monthly requirement of approx. 2,000 h - 1 h = 60 minutes (operating hours) in rail replacement services, for a total duration of 10 months. During the benefit period (10 months), a total of approx.
20,000 operating hours.
(3) The operating hours referred to in point 2 shall be a monthly guideline. In 2024 and in the option periods, the Client will call up at least 16,000 and not more than 22,000 operating hours per year, whereby the Contractor will not
is entitled to a minimum number of operating hours per month, but is entitled to remuneration of at least 16,000 operating hours for 2024 and the option periods annually (take-or-pay). The maximum call-off volume for the framework agreement is the sum of the annual maximum call-off volumes per lot, i.e. a total of 132,000 operating hours.
(4) For the provision of services, the Contractor shall be entrusted with complete rotations (1 round = all journeys to be made consecutively with a bus on one day). The rounds (4 pieces per day) have an average length of approx. 17 hours and are to be completed in a time window from 04:00 a.m. to 01:00 a.m. the following day. By way of derogation from this, the Client may also transfer continuous night rotations (i.e. until 4:00 a.m. the following day). Each round starts and ends at a BVG depot, which is currently located in:

The timetables contain the driving hours to be provided as well as all other necessary information on the mileage (e.g. routes, place and time of the start and end of the service, timetables, end points, etc.); an example schedule can be found in Appendix A to this specification. In addition, further information, such as routes, driving regulations at terminus, etc., will also be sent to the Contractor at least 3 weeks before the start of a mileage.
(6) During the provision of services, there may be changes to the aforementioned service, e.g. .dem the timetable, the numbers of the circuits or the route. In principle, the Contractor will be notified in writing of this change, especially if it leads to a reduction or increase in benefits, at least 3 weeks before it comes into force.
(7) Short-term, unforeseeable changes in mileage, in particular changes in circulation and timetable as well as changes to the route, e.g. due to construction and traffic measures, shall be communicated to the Contractor in writing immediately after becoming aware or, in the event of imminent danger or in urgent, non-postponable cases, orally to the designated contact persons of the Contractor and - if these cannot be reached - to the drivers concerned by the Bus Operations Control Centre (BLO).
(8) If, in particular due to unforeseeable changes or internal processes, the Client is unable to use a called mileage of the Contractor for the rail replacement service, the Client may also use the called mileage for the Client's regular services.
