Description:
Diesel supply

1. The subject of the contract is the successive supply of diesel fuel for the needs of Przedsiębiorstwo Gospodarki Komunalnej w Suwałki sp. z o. o. and the Road and Green Management Authority in Suwałki. 2.The estimated amount of diesel fuel shall be:

- for the needs of Przedsiębiorstwo Gospodarki Komunalnej w Suwałkach sp. z o. o. - 1 400 000 liters;

- for the needs of the Roads and Greenery Authority in Suwałki – 350,000 liters.

Note: the indicated quantities are indicative (estimated on the basis of previous diesel fuel supplies). The actual number of deliveries will result from the current needs of individual Ordering Parties, and the Contractor to whom the contract will be awarded will not be entitled to a claim for the implementation of deliveries in the quantities specified above.

2.The estimated amount of diesel fuel shall be:

- for the needs of Przedsiębiorstwo Gospodarki Komunalnej w Suwałkach sp. z o. o. - 1 400 000 liters;

- for the needs of the Roads and Greenery Authority in Suwałki – 350,000 liters.

Note: the indicated quantities are indicative (estimated on the basis of previous diesel fuel supplies). The actual number of deliveries will result from the current needs of individual Ordering Parties, and the Contractor to whom the contract will be awarded will not be entitled to a claim for the implementation of deliveries in the quantities specified above.

3.The fuel supplied by the Contractor must meet the standards (quality parameters) specified:

- in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680, as amended);

- in the Act of 25 August 2006 on the system of monitoring and controlling the quality of fuels (i.e. Journal of Laws of 2022, item 1315, as amended);

- PN-EN 590:2022-08 standard.

4.Pursuant to Article 101(4) of the PPL Act, in a situation where the documents describing the subject of the contract contain a reference to standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the PPL Act and such references were not accompanied by the expression "or equivalent", the Ordering Party shall allow solutions equivalent to those described in each such standard, European technical assessment, approval, technical specification, technical reference system. In view of the above, it should be assumed that each standard, European Technical Assessment, approval, technical specification, system of technical references appearing in the description of the subject of the contract is accompanied by the words 'or equivalent'.

5.Pursuant to Article 101(5) of the PPL Act, a contractor who invokes solutions equivalent to those described in those documents is obliged to prove, by attaching to the tender the relevant means of proof referred to in Articles 104 to 107 of the PPL Act, that the proposed solutions meet the requirements set out in the description of the subject of the contract to an equivalent extent.

6.Where the description of the subject of the contract indicates, in respect of certain materials or devices, trademarks, patents or origin, sources or a specific process that characterises the product, this means that they are given by way of example and indicate the minimum expected quality parameters and the required standard.

7.Za materials or equivalent devices, the Ordering Party shall recognize those that have quality and performance parameters at least at the level of parameters specified in the description of the subject of the contract or better.

8.The quality requirements of the main elements of the subject of the contract have been specified

in Annex 2 to the SWZ. The subject of the contract is standardized – it will be implemented identically, regardless of which Contractor performs it.

9.A detailed description of the subject of the contract and the scope of the Contractor's obligations is specified in Annex 2 to the SWZ and in Annex 4 to the SWZ - Model Contract.
