The subject of the order is the purchase of diesel fuel for buses together with delivery to the garage in Czołów, at ul. Kórnicka 1, in the total amount of 750,000 liters ON B7. The Employer allows the possibility of increasing the above. liters by 25% - purchase possible under the option right. The total quantity taking into account the option right 937 500 l. It is an aboveground tank with a capacity of 20,000 liters. The Purchaser will accept deliveries from Monday to Friday between from 7 to 15.

2.3. The Employer allows an increase in the basic volume of 750,000 liters ON B7 by 25%, i.e. by 187,500 liters at prices from the Contractor's offer, taking into account the provisions of the contract (including changes). The right of options should be understood as the entitlement, not the commitment of the Employer. In the event of increased needs of the Employer for diesel, he may exercise his right to options with an appropriate declaration of intent in this regard to the Contractor. Preliminary timetable for using these options in months: 12 (from the award of the contract).

2.4. The Ordering Party shall pay the Contractor the remuneration for deliveries made by transfer to the Contractor's bank account within 30 days (bid evaluation criteria - min. 14 days), counting from the date of delivery of the correctly prepared invoice to the Ordering Party.

2.5. Settlements between the Employer and the Contractor will be made only in Polish zlotys (PLN), excluding foreign currencies.

2.6. The Awarding Entity does not impose requirements related to the performance of the contract, referred to in Article 29 paragraph 4 of the Act.

2.7. The Employer provides for the possibility of significant changes to the provisions of the concluded contract in relation to the content of the offer, on the basis of which the Contractor was selected, in the event of at least one of the circumstances listed below, taking into account the conditions of their introduction:

2.7.1. Change of delivery date:

1) changes caused by force majeure, including natural disasters, atmospheric conditions preventing delivery on time;

2) changes resulting from circumstances attributable solely to the Employer, in particular suspension of delivery;

3) changes resulting from the temporary suspension of the production of goods or shortages of goods on the Polish market that are the subject of the contract, including as a result of the action of public administration bodies,

in the event of any of the circumstances listed in points 1) -3), the delivery date may be appropriately extended by the time necessary for its proper performance, but no longer than for the duration of these circumstances.

2.7.2. Change in the way the benefit is met:

1) changes caused by not buying the full amount of ON. In this case, the contract may be extended until the full quantity of ON B7 liters specified in the contract has been purchased.

2.7.3. Contractor's remuneration changes:

1) changes caused by the granting of promotional discounts by the Contractor.

If the Contractor grants promotional discounts to the client during the term of the contract, the discounts will also apply to that contract;

2) changes caused by an increase or decrease of the VAT or excise duty rate. If the change in the VAT rate or excise duty causes an increase in the costs of goods on the part of the Contractor, the Employer allows the possibility of increasing the Contractor's remuneration by an amount equal to the difference in the amount of VAT or excise duty paid by the Contractor. If the change in the VAT rate or excise duty will result in a decrease in the cost of goods on the part of the Contractor, the Employer allows the possibility of reducing the remuneration by an amount that is the difference of the amount of VAT or excise duty paid by the Contractor.

The provisions of art. 144 uPzp,

Amending the provisions of the concluded contract requires, otherwise being null and void, written form, unless the ToR, the contract or the Public Procurement Law provide otherwise.
